ADMINISTRATIVE ORDER NO. 58-96-16 <br />of the <br />EXECUTIVE DIRECTOR OF THE PUBLIC WORKS DEPARTMENT <br />EMERGENCY RULE AMENDING PARK RULE 1.003 <br />CONCERNING PARK CLOSURES. <br />The Executive Director of the Public Works Department of the City of Eugene finds <br />that: <br />A. As the designee of the City Manager, I issued Administrative Order No. 58-95-17 <br />on November 8, 1995 adopting an Emergency Rule Amending Park Rule 1.003 Concerning Park <br />Closures. <br />B. Subsequent to adoption of that Emergency Rule, City staff undertook a review of <br />other provisions of the Park Rules adopted by Administrative Order No. 58-94-12 on June 6, 1994 <br />to determine if revisions other than making the amendment to Rule 1.003 permanent, were <br />necessary. That review has not been completed, and the Emergency Rule adopted by <br />Administrative Order No. 58-95=17 has now expired. The reasons prompting issuance of that rule, <br />as set forth in finding C below, continue to exist. The amendment to Park Rule 1.003 should <br />therefore be reenacted in order to preserve the public welfaze and safety while City. staff is <br />determining if other revisions to the Pazk Rules aze necessary. <br />C Section 1.003 of those Rules sets forth the hours that City pazks aze closed. There <br />have been occasions in the past when the illegal activities of persons using a park and/or the <br />enforcement actions in curbing those activities have adversely impacted other parks and the <br />residents of the azeas in which the pazks aze located. It would therefore be in the public interest <br />and promote the welfaze and safety of those residents to amend Section 1.003 of the Pazk Rules <br />to provide for the temporary closure of pazks and/or facilities when the public need to preserve <br />the welfare and safety of residents in the vicinity of the pazk(s) outweighs the public's right of <br />access to parks and/or facilities: <br />D. Because of :anticipated enforcement activities, failure to act promptly in effecting <br />this amendment will seriously prejudice the public interest, and this amendment should therefore <br />be immediately effective. <br />Therefore, based upon the above findings, and pursuant to the authority ~ of Section <br />2.019{6) of the Eugene Code, 1971, Park Rule 1.003 is hereby amended to provide: <br />Emergency Rule - 1 <br />
