ADMINISTRATIVE ORDER NO. S~3_ ~h - D 3 <br />of the <br />City Manager of the City of Eugene - <br />Proposed Adoption of Vehicle Impoundment Notice and Hearing <br />Procedures Administrative Rule R-5.695, and Repeal of <br />Administrative Order No. 58-95-16 <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority of Section 2.019(5) of the Eugene Code, 1971, on <br />October 12, 1995 the City Manager issued Administrative Order No. 58-95-16 adopting <br />Temporary Vehicle Impoundment Notice and Hearing Procedures Administrative Rule R- <br />5.695. <br />B. I propose to amend Rule R-5.6795-B-1(a) and 2(b) to delete the requirement <br />to provide notice to lessors or security interest holders for vehicles impounded pursuant to <br />Section 5.135 of the Eugene Code, 1971, as such notification is not required under state law, <br />and represents an unnecessary expense to the City, and to adopt. Temporary Vehicle <br />Impoundment Notice and Hearing Procedures Administrative Rule R-5.695, as amended <br />herein, as a permanent rule. <br />Now, therefore, based on the above findings, I hereby propose to adopt the following <br />Vehicle Impoundment Notice and Hearing Procedures Administrative Rule R-5.695 to <br />provide: <br />Proposed Vehicle Impoundment Notice and Hearing <br />Procedures Administrative Rule R-5.695 <br />R-5.695-A Authori <br />These regulations are authorized by Section 2.019, 5.695, 5.697, and 5.698 of the <br />Eugene Code, 1971, and• are established to implement those provisions of Chapter 5 of the <br />Eugene Code, 1971 that authorize or direct the impoundment of vehicles. Unless a different <br />procedure is provided in a prov~~ion of the Eugene Code, 1971, these procedures shall be <br />followed when a vehicle is impounded, or proposed to be impounded by the City. <br />R-5.695-B Notice Prior to Impoundment for Vehicles Stored on the Street. <br />1.
