. ~ ~, ,: <br />ADMIhTISTRATIVE ORDER N0.58-96-10 <br />of the <br />City Manager Pro Tem of the City of Eugene <br />CONCERNING NOTICE OF PROPOSED INCREASE IN <br />WASTEWATER USER FEES AND. REPEAL OF ADMII~IISTRATIVE <br />ORDER N0.58-95-05=F <br />The City Manager Pro Tem of the City of Eugene finds as follows: <br />A. Section b.411 of the Eugene Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for wastewater service and for regional <br />wastewater service.. In accordance with the procedures set forth therein, on May 18, 1995, I adopted <br />Administrative Order No. 58-95-OS-F establishing sewer user rates for the fiscal year commencing <br />July 1, 1995. <br />~~= B. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br />investigation of the revenue needs of the City in providing these services and reviewed the <br />recommendation of the Metropolitan Wastewater Management Commission (MWMC) staff. <br />C. The MWMC staffproposal revises the method used to allocate costs among customer <br />classes, reallocates costs between the flat monthly component of the MWMC fee and the flow based <br />component of that fee and creates two new high-strength classes. The customer service charges <br />recommended by MWMC staff is contained herein; and reflects this revised cost allocation. The . <br />M WMC has not yet acted upon. the staff recommendation, and is_ expected to do so prior to f nal <br />action on the fees proposed herein. <br />' D. Based on that~investigation and recommendation, Iintend to revise the user fees for <br />wastewater service and regional wastewater treatment service as set forth in the Notice of Intended <br />Fees attached as Exhibit A hereto and incorporated herein by reference, and repeal the currently <br />effective fees established by Administrative Order No. 58-95=05-F. I find the proposed fees are in <br />compliance with the Council's directive that the costs of providing such services be recovered from <br />the beneficiaries of the services, and other applicable policies and directives of the Council; are <br />consistent with applicable federal and state regulations and the recommendations of MWMC staff; <br />are comparable to the amounts charged by the City of Springfield and other such service providers; <br />will preserve equity between different classes of ratepayers; and are based on the proposed budgets <br />of the City of Eugene and MWMC. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to he Mayor and City Councilors, the news media, <br />any person who has. requested notice, to interested: governmental agencies (including the United <br />States Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board), posted at two locations at City Hall, published on two separate <br />Administrative Order -1 <br />
