ESTABLISHING FEES FOR PROCESSING <br />EROSION PREVENTION AND CONSTRUCTION <br />SITE MANAGEMENT PRACTICES PERMITS <br />The City Manager Pro Tem of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 6.635 of the Eugene Code, <br />1971, on December 5, 1996 I adopted Administrative Order No. 58-96-27 proposing the adoption <br />of fees for processing erosion prevention and .construction site management practices permits. The <br />fee structure provides a basis for determining the amount of cost for an erosion prevention permit <br />i <br />for a variety of land use. conditions. <br />B. ~ Notice of the proposed fees was :provided to the Mayor and City Councilors, <br />. published in the Register Guard, a newspaper of general circulation within the City, and posted at <br />two locations at City Hall on Dec 10; 1996. The Notice was also provided to persons who had <br />requested notice, and made available for inspection by interested.persons at the City's Public Works <br />ormal business <br />. - ~ Department, Engmeering Division, 858 Pearl Street, Eugene, Oregon 97401 durmg n <br />hours (9:00 a.m. toS:00 p.m., Monday through.Friday, exclusive of holidays), and made available <br />to the general. public through Eugene's Home Page on the Internet. <br />C. The Notice provided that written comments would be received thereon until midnight, <br />January 7,1997, more than 1 S days from the first date of publication and posting. Written comments <br />were received from William Slattery and Robert L. Breeden to which I make the following findings: <br />1 Comment 1: How will the fees be used? <br />indin :The fees will be used to pay staff costs associated with the review of <br />erosion permit applications, inspection of erosion related work, and enforcement activities. <br />Two erosion specialists will be •hired to implement the program. The fees will cover costs <br />~° <br />for these resources. <br />Comment 2: Is there a plan check fee also? <br />Findin :The fees that were sent out for public comment were listed as permit fees <br />but in reality they are plan check: permit and inspection fees combined.
