ADMINISTRATIVE ORDER NO. 58-97-47 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF MWMC <br />PROVISIONS OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGIES <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager <br />of the City of Eugene to determine and set fees and charges to be imposed by the City for <br />services, goods, use of municipal property, and licenses and permits, and specifically systems <br />development charges. Section 7.710 of the Eugene Code, 1971 further authorizes the City <br />Manager to adopt and/or amend by administrative order, the methodologies used for establishing <br />the systems development charges, and provides this may be effected concurrent with the <br />establishment or revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, and in response to a resolution <br />passed by the Metropolitan Wastewater Commission (1VIWMC), I intend to amend portions of the <br />Systems Development Charge Methodologies relating to MWMC by: (1) redefining the MWMC <br />SDC as a combined reimbursement fee and improvement fee; (2) adding and defining a flow <br />estimation units (FEU) category; (3) establishing a process for reviewing the capital improvement <br />program and calculating the SDC fees to be charged when a large volume user connects to the <br />system; resulting in revisions to the Table of Contents, Table 1 on page 3, Figure 1 on page 5, <br />Section 4.2 starting on page 7, Table 2 on page 15, Appendix B on pages B-1 and B-2, Appendix <br />D on pages D-6 through D-10, and Appendix G on pages G-3 through G-5; and (4) revising the <br />title and paragraph 1 of the text of Section 2.4 on page 6 by inserting the phrase "City of Eugene" <br />to clarify it references expending Ciry of Eugene SDC's, all as set forth in the Notice of Intended <br />Amendment of MWMC Provisions of Systems Development Charge Methodologies attached as <br />Exhibit A hereto and incorporated herein by reference. <br />C. I find that the revisions to the Methodologies and the fees as set forth in Exhibit <br />A hereto are consistent with adopted policies and ordinances of the City and with policies adopted <br />by MWMC, in conformity with applicable state law, and should be implemented effective July <br />7, 1997, and those portions of the Systems Development Charge Methodologies adopted by <br />Administrative Order Nos. 58-97-02-F-2 amended as of that effective date. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, published in <br />the Register Guard, a newspaper of general circulation within the City, posted at four public <br />locations, and copies of the Proposed Revisions to the .Systems Development Charge <br />Administrative Order - 1 osii6~9~ <br />
