ADMINISTRATIVE-.ORDER N0.58-97-12 <br />of the <br />-City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED FEES FOR ENGINEERING. SERVICES <br />FOR PRIVATELY CONSTRUCTED PUBLIC IMPROVEMENTS <br />AND REPEALING ADMINISTRATIVE ORDER NO.58-96-14-F <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene; Code, 19,71 authorizes the -City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods; use of ' <br />municipal property, and licenses and permits. In-accordance with-the procedures set forth <br />therein, and the further authority.of Section 7-:130 of the Eugene Code, 197 i, on August 1, 199b, <br />City Manager adopted Administrative Order No. 58-96-14-F establishing fees .for engineering <br />services for privately constructed public improvements. <br />B.' These engineering services are; provided on request to private parties and other' <br />governmental agencies that construct projects that become public improvements upon <br />completion and are, charged for on an hourly basis. Hourly. rates are established ~t the start of <br />each fiscal year to recover the full cost of engineering services for each classification of _ <br />engineering employee: I therefore intend to repeal the currently effective fees set forth in <br />Administrative Order No. 58-96-14-F and establish fees based on the. hourly rates ofengineering <br />' ,employees for the 1997-98 fiscal year as 'set-.forth in the Ncstice of Intended Fees attached as'~ . <br />Exhibit. A hereto .and .incorporated herein by reference.. <br />C. The .fees set forth. in Exhibit A hereto are consistent with applicable policies and <br />directives of the City Council, comparable to the fees established in-other jurisdictions and <br />private businesses for providing suck services; are based on the hourly rates of engineering` <br />employees, and are necessary in order to comply with the City Council's directive and the <br />requirements of, Section 7.130 of the. Eugene Code; 1971 that he fee charged for these services <br />recover the City's full costs, including plan review, .engineering, inspection and' overhead. costs.. <br />` On the basis of these findings; I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two <br />locations at`Cty Ha11, -and be made available for interested persons at the of#ices of the City _ <br />.Manager; 777 Pearl Street, Eugene; Oregon 97401; during normal business hours (8:00 a:m. to <br />5:00 pm. Monday through Friday, exclusive of holidays). <br />' 2. All persons desiring to comment thereon shall submit written comments. as set , <br />forth in the Notice.
