ADMINISTRATIVE ORDER NO. 58-97-07-F <br />of the <br />City Manager of the City of Eugene <br />:AMENDMENT OF MWMC PROVISIONS OF <br />. SYSTEMS DEVELOPMENT CHARGE METHODOLOGIES <br />ADOPTED BY ADMINISTRATIVE ORDER NO. 58-97-02-F. <br />The City Manager of the-City of Eugene-finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the -City Manager <br />of the City of Eugene to determine and set fees and charges to be imposed by the City for <br />. services,- goods, use of municipal property, and licenses and permits, and specifically systems <br />development charges. Section 7,710 of the Eugene Code, 1971 further authorizes the City <br />Manager to adopt and/or amend by administrative order, the methodologies used for establishing. <br />the systems development charges, and provides this may be effected concurrent with the <br />establishment or revision of a systems development charge. <br />B. In accordance with the procedures set forth therein, and in response to a resolution <br />passed by the Metropolitan Wastewater Commission (MWMC), on May 23, 1997 I issued <br />;Administrative Order No. 58-97-07 and notified the Mayor and City. Council that I intended to <br />amend portions of the Systems Development Charge Methodologies relating to MWMC by: (1) <br />,redefining the MWMC SDC as a combined reimbursement fee and' improvement fee; (2) adding <br />and defining a flow estimation units (FEII) category; (3) establishing a process for reviewing the <br />capital improvement program and calculating the SDC_ fees to be charged when a large volume <br />user connects to the system; resulting in revisions to Table 1 on page 3, Figure 1 on page 5, <br />Section 4.2 starting on page 7, Table 2 on page 15, Appendix B on pages B-1 and B 2, Appendix <br />D on pages D-6 through D-10, and Appendix G on pages G-3 through G-5; and (4) revising the <br />title-and paragraph. l of the text of Section 2.4 on page 6 by ,inserting the phrase "Ciity of Eugene" <br />to clarify it references expending City of Eugene SDC's, .all as set forth in the Notice of Intended <br />Amendment of MWMC Provisions of Systems- Development Charge Methodologies attached as <br />Exhibit A thereto and incorporated therein by reference. <br />C. The Notice was published on May 29, June 1 and 4; 1997 in the Register Guard, <br />a newspaper of general circulation within the City; posted at four public locations on May 29, <br />1997, and-copies of the Proposed Revisions to the -Systems. Development Charge Methodologies <br />were made available for inspection by interested persons at City Hall, 777 .Pearl Street, Eugene., <br />Oregon 97401; the City Public Works Building Lobby, 858 Pearl Street, Eugene, Oregon 97401; <br />the Permit. and Information Center Lobby, Atrium Building, 99 West 10th Avenue, Eugene, <br />. Oregon 97401; and the Eugene Public Library, 100 West 13th Avenue, Eugene, 'Oregon 97401, <br />during normal business. hours (8:00 a.m. to 5:.00, p.m., Monday through Friday,- exclusive of <br />holidays, except for the Library). The Notice provided that written comments could be submitted. <br />thereon for a period of 30 days from the first date of publication and posting. <br />D.
