1.2.1 The permit applicant has completed to the satisfaction of the City <br />Engineer or designee a project of similar or greater magnitude within the past 24 <br />months which was constructed under aright-of--way permit issued by the City of <br />Eugene; or, <br />1.2.2 The permit applicant has on file with the City a Public Way <br />performance bond as described in Section R-7.302-H-2 below. <br />2. A public way performance bond or security deposit shall be required prior to <br />issuance of an annual blanket permit.. The bond or security deposit shall be the greater of either <br />$20,000 or the total cost of trench backfill, compaction, pavement restoration and associated <br />traffic control for 20 % the anticipated work to be performed under the annual permit. <br />2.1 The permit applicant shall provide the City with cash, a surety performance <br />bond which has been fully executed by applicant and its surety, guaranteeing Applicant's <br />obligations under this paragraph or another type of security acceptable to Ciry, in its sole <br />discretion. If applicant provides City with a bond, it shall be in a form acceptable to City, <br />in its sole discretion. <br />3. The permit applicant shall agree to indemnify and hold the City harmless from any <br />loss, cost or damages arising out of or in connection with any activities associated with the permit. <br />R-7.302-I Transfer of Telecommunication Licenses <br />In the event a telecommunications license is transferred under the conditions contained in <br />Chapter 3 of the Eugene, Code 1971, the new licensee shall be responsible for all the previous <br />licensee's outstanding agreements and obligations to the City regarding use of the public way. <br />These shall include but not be limited to maintenance of restored utility trenches within the public <br />way and completion of all work authorized by outstanding permits. <br />This Rule shall become effective immediately and remain in effect for a period of 180 days <br />from the date hereof unless replaced earlier by an emergency rule, temporary rule, or permanent <br />rule adopted in accordance with the provisions of Section 2.019 of the Eugene Code, 1971. <br />~~~ , <br />Dated this ~~ day of ~ ' ~---- , 1997. <br />~, City Manager <br />Administrative Order - 7 05/29/97 <br />
