.-. _<-.z <br />ADMINISTRATIVE ORDER NO.~~- 'SS` ~ 7' ~ ~ <br />: of the <br />City Manager of the City of Eugene <br />CONSTRUCTION WITHIN AND USE OF THE PUBLIC WAY <br />EMERGENCY ADMINISTRATIVE RULE R-7.302 <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br />rules for implementation of any provisions of that Code. In addition to that authority, Section <br />7.302 establishing policies, standards and procedures for the placement of facilities within the <br />public way was amended by Ordinance No. 20083 passed by the City. Council and approved by <br />the Mayor on Apri128, 1997. The amendments contained in Ordinance No. 20083 include the <br />creation of Section 7.302(6) of the Eugene Code, 1971, which requires establishment of <br />administrative rules and .specifies minimum requirements for said rules. <br />B. Adoption of this Construction Within and Use of the Public Way Emergency <br />Administrative Rule R-7.302 is necessary in order to ensure that use of the public way is in <br />compliance with the newly adopted provisions of the Eugene Code, 1971. Failure to act promptly <br />would prejudice the effectiveness of the City's programs and policies relating to construction and <br />use of the public way. <br />C. Adoption of this Emergency Rule is authorized by Section 2.019(6) of the Eugene <br />Code, 1971. <br />Therefore, based upon the above findings, which are hereby adopted, and pursuant to the <br />authority of Sections 2.019(6) and 7.302 of the Eugene Code, 1971, the following Construction <br />Within and Use of the Public Way Emergency Administrative Rule R-7.302 is hereby adopted, <br />to provide: <br />CONSTRUCTION WITHIN AND USE OF THE PUBLIC WAY <br />EMERGENCY ADMINISTRATIVE RULE R-7.302 <br />R-7.302-A Construction Within and Use of the Public Way -Policy <br />In order to create attractive and healthy neighborhood environments and to protect the <br />public's right for safe unobstructed use of the public way, applicants wishing to perform <br />construction in, or use the public way, shall first obtain a written permit and shall conform with <br />the standards and procedures provided for in these rules and the provisions, specifications, and <br />conditions contained within the manual on Utility and Right-of-Way Permits.
