Finding: Staff agrees that the term "facility" .needs to be defined. The intended <br />..meaning of the term "facility"in the proposed fee schedule is that each facility. type, e.g. <br />electric, water, or telecommunication facility; under a single provider's ownership and <br />installed under a single project/permit shall be considered a "facility" for .purposes of <br />calculating permit fees: In the example. given of two EWEB-owned electric conduits <br />installed in a joint trench, both conduits would be considered a single facility for purposes. <br />of permit fee assessment so long as both conduits were installed under the same project. <br />This definition will be included in the fee table; to clarify the meaning. <br />E. I find that the proposed increase in excavation permit fees and new right-of-way <br />cut permit fees for construction within. and use of the public way are consistent with applicable <br />policies and directives of the City Council, including policies developed through the Eugene <br />Decisions process, are based on the City's estimation of the costs associated-with providing. the <br />services, and are necessary in order ,to implement newly revised, provisions of the Eugene Code; <br />1971 and recover the cost from the beneficiaries of the services. `Administrative Order No. 58-96- <br />13-F should. be repealed, and-the Right-of=Way Use Permit Fee schedule attached. as Exhibit A <br />hereto adopted as amended herein. <br />On the basis of these findings, I order that: <br />1. Administrative Order No. 58-96-13-F is hereby repealed; as of midnight, June 30, <br />..1997. <br />2.
