Waste Hauler discharging wastes at a unpermitted discharge point (second <br />violation). The commenter questioned what happened following the first violation, <br />and why an irresponsible hauler would be given a second chance. <br />Finding: The penalty for the first incident of discharging at an unpermitted <br />discharge point. is raised from $500 to $1000 in the proposed changes to the <br />Enforcement Response Guide. Escalating or progressive enforcement is included <br />throughout the Enforcement Response Guide, and is a requirement in the federal <br />pretreatment regulations for preparation of enforcement plans. Allowing a hauler <br />a second .chance following a first violation is in accordance with this philosophy. <br />Following a second violation, a hauler's permit would be revoked, and discharge <br />privileges removed. <br />F. In addition to the specific findings set forth above, I find that the proposed <br />revisions are consistent with the directions of the City Council, and are necessary in order <br />to recover the City's costs associated with monitoring the City's industrial pretreatment <br />program and achieving compliance therewith by industrial users in accordance with the <br />Council's recent amendment of Section 2.018(5) of the Eugene Code, 1971 which <br />increased the maximum amount of civil penalty that may be imposed for violations of that <br />program. <br />On the basis of these findings, 1 order tha#: <br />1. Appendix A, Industrial Pretreatment Program Enforcement Response Guide <br />is .hereby amended as proposed, as reflected in the attachment hereto, which is <br />incorporated herein by reference. <br />2.
