Waste Hauler discharging wastes at a unpermitted discharge point (second violation). The commenter questioned what happened following the first violation, and why an irresponsible hauler would be given a second chance. Finding: The penalty for the first incident of discharging at an unpermitted discharge point. is raised from $500 to $1000 in the proposed changes to the Enforcement Response Guide. Escalating or progressive enforcement is included throughout the Enforcement Response Guide, and is a requirement in the federal pretreatment regulations for preparation of enforcement plans. Allowing a hauler a second .chance following a first violation is in accordance with this philosophy. Following a second violation, a hauler's permit would be revoked, and discharge privileges removed. F. In addition to the specific findings set forth above, I find that the proposed revisions are consistent with the directions of the City Council, and are necessary in order to recover the City's costs associated with monitoring the City's industrial pretreatment program and achieving compliance therewith by industrial users in accordance with the Council's recent amendment of Section 2.018(5) of the Eugene Code, 1971 which increased the maximum amount of civil penalty that may be imposed for violations of that program. On the basis of these findings, 1 order tha#: 1. Appendix A, Industrial Pretreatment Program Enforcement Response Guide is .hereby amended as proposed, as reflected in the attachment hereto, which is incorporated herein by reference. 2. The City Recorder is directed to replace the Appendix A attached to Administrative Order No. 58-93-17 with a copy of the Appendix A attached hereto, and to reflect this amendment thereon and in the City's records.
