ADMINISTRATIVE ORDER NO. 58-97-19 <br />of the City Manager <br />PROPOSED AMENDMENTS TO APPENDIX A OF <br />INDUSTRIAL PRETREATMENT PROGRAM ADMINISTRATIVE RULE R-6.463 <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 6.463 <br />(subsequently amended and renumbered 6.581) of the Eugene Code, 1971, the current <br />Industrial Pretreatment Program Administrative Rule R-6.463 and Appendix A thereto were <br />adopted by Administrative Order No. 58-93-17 on July 30, 1993. <br />B. Appendix A consists of the Industrial Pretreatment Program Enforcement <br />Response Guide authorized to be established by the City Manager under Sections <br />2.018(5) and 6.501 to 6.596 of the Eugene Code, 1971. <br />C. Subsection 2.018(5) of the Eugene Code, 1971 was recently amended by the <br />City Council to increase the maximum amount of civil penalty that may be imposed for <br />violations of Sections 6.501 to 6.596 of the Eugene Code, 1971, and Appendix A to <br />~ Administrative Rule R-6.463 should therefore be amended to increase the penalties for <br />some violations, adjust other penalties based on experience with the enforcement program, <br />add a new provision for Pollution Management Practices, and reformat the Enforcement <br />Response Guide for readability purposes, all as set forth in the attachment to Exhibit A <br />hereto. <br />D. The proposed revisions are consistent with the directions of the City Council, <br />and are necessary in order to recover the City's costs associated with monitoring the City's <br />industrial pretreatment program and achieving compliance therewith by industrial users. <br />Based upon the above findings, which are hereby adopted, and pursuant to the <br />authority contained in Sections 2.018(5), 2.019 and 6.501 #0 6.596 of the Eugene Code, <br />1971, I hereby propose to amend Appendix A of Industrial Pretreatment Program <br />Administrative Rule R-6.463 adopted by Administrative Order No. 58-93-17 on July 30, <br />1993 as set forth in the Appendix A attachment to Exhibit A hereto. <br />Public notice of this proposed amendment to Appendix A of R-6.463 shall be given <br />by making copies thereof available to all current permittees, any person who has requested <br />such notice, and by publication thereof in the Register Guard, a newspaper of general <br />circulation within the City for at least five days, providing interested persons an opportunity <br />of not less than 15 days to submit data or comments thereon.
