NOTICE OF INTENDED RULEMAKING PROPOSED AMENDMENT AND ADOPTION, OF CONSTRUCTION WITHIN AND USE OF THE PUBLIC WAY EMERGENCY ADMINISTRATIVE. RULE R-7.302 AS A PERMANENT RULE AND REPEAL OF ADMINISTRATIVE-ORDER N0.58-97-08 . NOTICE iS HEREBY GIVEN. that pursuant to the authority contained in Sections 2.019 and 7.302 of the Eugene Code, 1971, the City Manager of the City of Eugene, intends. to adopt as a permanent rule_Construction Within and Use of-the Public Way Emergency Adminis#rative Rule R-7.3:02 adopted by Administrative Order No. 58-97-08 on June 5, 1997, as amended by: (a) Adding a definition for "conduit" and amending the definition of "street segment" in R-7.302-B; (b) revising the notice requirements in R-7.302-C to clarify the purpose and intent of notification and requiring providers to establish the timing and format of the notice with evaluation and monitoring by the City;; {c) revising R- 7.302-D-1 by adding "pay telephones" and "associated poles or support structures" to the non-applicable facilities, revising the location standards in R-7.302-D-2; {d) adding a provision, to R-7.302-E-3 that requires the City Engineer, with input from providers to complete a standards development process prior to imposing permit conditions relating to standards for conduit size, capacity to be installed, or the provision of extra capacity; and (e) deleting the. performance bond or security deposit requirements of R-7.302-H-2 for issuance of annual blanket permits... The amendment and adoption of Construction Within and Use of the Public Way Emergency Administrative Rule R-7.302 as a permanent rule is necessary. in order to ensure that use of.the public way is in compliance with current provisions of the Eugene Code, 1971 relating to .construction and use of the public way. The Rule may be reviewed at the office of the Public Works Department, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours (9:00 a:m. to 5:0.0 p:m., Monday through. Friday, exclusive of holidays). All persons wishing to comment thereon or object thereto must submit their comments or objections to the City's Public Works Department, 858 Pearl. Street, Eugene, - Oregon 97401, in writing, within thirty (30) days of the date of the first publication hereof, as indicated below. The City Manager will thereafter. adopt the Proposed Construction Within and Use of the Public Way Administrative Rule R-7.302, as proposed, or as .amended in response to comments received.
