ADMINISTRATIVE ORDER N0.58-00-27 <br />of the <br />.City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED .AMENDMENT OF THE FEE <br />SCHEDULE TO PROCESS EROSION PREVENTION- AND <br />- CONSTRUCTION SITE MANAGEMENT PRACTICES PERMITS. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. " <br />B. In accordance with the procedures set forth therein, on January 22, 1997, <br />Administrative Order No. 58-96-27-F was issued establishing a schedule of fees for processing <br />erosion prevention and construction site management practices permits. <br />C. The currently effective fee schedule for processing erosion prevention and <br />construction site management practices permits should be amended to add a surcharge fee for <br />;' performing work without a permit as set forth in the Notice of Intended Fees attached as Exhibit A <br />- hereto and incorporated by reference. <br />D. The fee set forth in Exhibit A hereto is consistent with applicable policies and <br />directives of the City Council, comparable to the fees established in other jurisdictions, and is based <br />on the cost to the City associated with providing the services to beneficiaries of the service. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two <br />locations at City Hall, .provided to any persons who have requested such notice, and be made <br />available for inspection by interested persons at the offices of the City's Public Works Department, <br />Engineering Division, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours (9:00 <br />a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays), and made available to the general <br />public through Eugene's Home Page on the Internet. <br />2. All persons desiring to comment thereon shall submit written comments as set forth <br />in the Notice.
