ADMINISTRATIVE ORDER NO. 58-00-27-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE FEE SCHEDULE TO PROCESS ' EROSION <br />PREVENTION AND CONSTRUCTION SITE MANAGEMENT PRACTICES <br />PERMITS; RATIFYING THE UNAMENDED FEES AND REPEALING <br />ADMINISTRATIVE ORDER N0.58-96-27-F <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. <br />B. In accordance with the procedures set forth therein, on October 17, 2000, <br />Administrative Order No. 58-00-27 was issued proposing to amend the fee schedule to process <br />erosion prevention and construction site management practices permits by adding a surcharge fee <br />for working without a permit. Notice of the proposed fee amendment was provided to the- Mayor <br />and City Councilors, posted at two locations at City Hall on October 20, 2000, provided to any <br />persons who had requested such Notice, made available for inspection by interested persons at the <br />offices of the City's Public Works Department, Engineering Division, 858 Pearl Street, Eugene, <br />Oregon 97401 during normal business hours (9:00 a.m. to 5:00 p.m., Monday through Friday, <br />exclusive of holidays), and made available to the general public through Eugene's Home Page on <br />the Internet. <br />C. The Notice provided that written comments would be received within 15 days of the <br />date of posting. No comments were received within the time nor in the manner provided in the <br />Notice. <br />D. I find that the surcharge fee for working without a permit as set forth in Exhibit A <br />hereto is consistent with applicable policies and directives of the City Council, comparable to the <br />fees established in other jurisdictions, and is based on the cost to the City associated with providing <br />the service to beneficiaries of the service. The unamended fees set forth in Exhibit A hereto should <br />be ratified and Administrative Order No. 58-96-27-F should be repealed as of the effective date of <br />this order. <br />Based on the above findings which are hereby adopted, I order that: <br />1.
