ADMINISTRATIVE ORDER N0.58-01-1~ <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED INCREASE <br />IN MWMC WASTEWATER USER FEES <br />The City Manager of the City of Eugene finds as follows: <br />C (~G <br />A. Section 6.411 (formerly Section 7.020) of the Eugene, Code,1971 authorizes the City <br />Manager to determine and set fees and charges to be imposed by the City for wastewater service, <br />regional wastewater service, and stormwater service. In accordance with the procedures set forth <br />therein, on November 10, 1999, Administrative Order No. 58-99-20-F was adopted establishing <br />amended MWMC Septage User Fees effective on bills issued after November 1, 1999. <br />B. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have investigated the <br />City's current revenue needs and cost of operation of the City's wastewater service system and <br />reviewed the recommendation of the Metropolitan Wastewater Management Commission (MWMC) <br />staff. I propose to increase the user fees for wastewater service, and regional wastewater treatment <br />service as set forth in Exhibit A attached hereto. The proposed increases are necessary in order to <br />comply with the Council's directive that the costs of providing such services be recovered from the <br />beneficiaries of the services, and other applicable policies and directives of the City Council; are <br />consistent with applicable federal and state regulations and the recommendations of MWIVIC; <br />comparable to the amounts charged by the City of Springfield and other such service providers; <br />preserve the equity between different classes of ratepayers; and are based on the proposed budgets <br />of the City and MWMC. The MWMC has not yet acted on the staff recommendation, and the <br />MWMC portion of the fees proposed herein my be adjusted by the Commission or in response to <br />public comments hereon. <br />C. Based on that investigation and recommendation, Iintend to revise the wastewater <br />user fees for MWMC wastewater service as set forth in the Notice of Intended Fees attached as <br />Exhibit A hereto and incorporated herein by reference. The increases should be implemented and <br />effective for all bills issued on or after July, 1, 2001, except for septage hauler fees which will be <br />effective for all septage hauler charges incurred after July 1, 2001, and Administrative Order No. 58- <br />99-20-F should be repealed. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, the news media, <br />any person who has requested notice, to interested governmental agencies (including the United <br />States Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board), posted at two locations at City Hall, published on two separate <br />Administrative Order - 1 <br />C:\WINDOWS\TEMP\Admin Order 58-O1-Il.wpd <br />
