ADMINISTRATIVE ORDER N0.58-01-10-F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF MWMC WASTEWATER USER FEES AND <br />REPEAL OF ADMINISTRATIVE ORDER N0.58-99-20-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City <br />Manager to determine and set fees and charges to be imposed by the City for wastewater service, <br />regional wastewater service, and stormwater service. <br />B. In accordance with the procedures set forth therein, on June 4, 2001, I issued <br />Administrative Order No. 58-O1-10 proposing. an increase in MWMC wastewater user fees as set <br />forth in the Notice attached thereto, and the revision of the rates adopted by Administrative Order <br />No. 58-99-20-F. <br />C. Copies of the Notice were provided to the Mayor and City Councilors, the news <br />media, any person who had requested notice, and posted at two locations. at City Hall on June 8, <br />~~ 2001. The Notice was also published in the Register Guard, a newspaper of general circulation <br />within the City, on June 8 and 13, 2001, and made available for inspection by interested persons at <br />the offices ofthe Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The notice <br />was also provided to interested governmental agencies (including the United States Environmental <br />Protection Agency, the Department of Environmental Quality, MWMC, and the Eugene Water & <br />Electric Board). <br />D. The Notice provided that written comments thereon could be submitted for a period <br />of 10 days from the first date of publication and posting, or at a public hearing to be held on June <br />19, 2001. No written comments were received within the time or in the manner required by the <br />notice. <br />E. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an <br />investigation of the revenue needs of the City in providing these services and reviewed the <br />recommendation of the Metropolitan Wastewater Management Commission (MWMC). <br />F. Based on that investigation and recommendation, and the findings set forth herein, <br />I find the proposed wastewater user fees are in compliance with the Council's directive that the costs <br />of providing such services be recovered from the beneficiaries of the services, and other applicable <br />policies and directives ofthe Council; are consistent with applicable federal and state regulations and <br />the recommendations of MWMC; are comparable to the amounts charged by the City of Springfield <br />and other such service providers; and are based on the proposed budgets of the City and MWMC. <br />Administrative Order. - 1 <br />C:\WINDOWS\TEMP\01 Wastewater2ao.wpd <br />
