ADMINISTRATIVE ORDER N0.58-99-20 of the City Manager of the City of Eugene CONCERNING NOTICE OF INTENDED INCREASE IN MWMC SEPTAGE USER FEES The City Manager of the City of Eugene finds as follows: A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes the City Manager to determine and set fees and charges to be imposed by the City for wastewater service, regional wastewater service, and stormwater service. In accordance with the procedures set forth therein, on June 26, 1998, Administrative Order No. 58-98-11-F establishing sewer user rates for the fiscal year commencing July 1, 1998 was adopted. B. The MWMC has proposed to increase the septage user charge for MWMC wastewater service. In July 1998 there was a surcharge added to the rate to cover costs for improvements to the septage facility, which will expire on September 30, 1999. The proposed rate was established by surveying other wastewater facilities that accept septage discharge throughout the state and averaging the rate charged by those .agencies. At the August 18, 1999 MWMC meeting the Commission approved the policy of setting septage rates at market levels, and adopted the proposed rates. ' C. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have conducted an investigation of the revenue needs of the City in providing these services and reviewed the recommendation of the Metropolitan Wastewater Management Commission (MWMC). D. Based on that investigation and recommendation, Iintend to revise the septage user fees for MWMC wastewater service as set forth in the Notice of Intended Fees attached as Exhibit A hereto and incorporated herein by reference. I fmd the proposed fees are in compliance with the Council's directive that the costs of providing such services be recovered from the beneficiaries of the services, are consistent with applicable federal and state regulations and the recommendations of MWMC, and should be implemented effective on all bills issued after November 1, 1999. Wastewater rates other than the septage rates will remain unchanged. Only those portions of the wastewater and stormwater rate schedules adopted by Administrative Order No. 58-96-10-F in conflict herewith should be amended as of that effective date. On the basis of these fmdings, I order that: 1. Copies of the Notice be provided to the Mayor and City Councilors, the news media, any person who has requested notice, to interested governmental agencies (including the United States Environmental Protection Agency, the Department of Environmental Quality, MWMC, and the Eugene Water.& Electric Board), posted at two locations at City Hall, published on two separate Administrative Order - 1 r:\adminord\fees~nwmcsepiao.wpd(09113/99)
