NOTICE OF INTENDED RULEMAKING <br />PROPOSED AMENDMENT OF PARK RULES 1.003, 1.007, <br />(_ 1.050, AND 1.070 AND REPEAL OF PRIOR ORDERS. <br />NOTICE IS HEREBY GIVEN that pursuant to the authority contained in Section 2.019 <br />of the Eugene Code, 1971, and Administrative Order No. 58-92-21, the Executive Director of the <br />Public Works Department of the City of Eugene, intends to amend the Park Rules to: <br />Amend Rule 1.003 as previously amended by an expired Emergency Rule <br />to authorize the Executive Director to temporarily close all or any portion of a park <br />or facility upon finding that conditions that threaten the welfare or safety of nearby <br />residents exist, and to restrict vehicular access to City parks during hours the parks <br />are normally open upon finding such restriction is necessary for the preservation <br />of the health, welfare and safety of the citizens of the City; amend Rule <br />1.007(h)4.a. to include the Park Blocks as an area in which the possession or <br />consumption of hard liquor, malt beverages and alcoholic liquor is prohibited; <br />amend Rule 1.050(8) to delete Gilliam Park at 3055 Gilliam Road as a dog off leash <br />area, as the City no longer owns that property; amend Rule 1.070(1) to prohibit <br />certain acts or conduct within landscaped areas of City parks; and to readopt the <br />remaining unamended Park Rules in accordance with the procedures of Section <br />2.Oi9 of the Eugene Code, 1971. <br />Adoption of the proposed amendments is necessary in order to insure the preservation of <br />', the public welfare and safety of persons using City parks. The unamended provisions of the Park <br />.Rules which were adopted pursuant to authority of sections of the Eugene Code, 1971 which have <br />been repealed, should be readopted at this time following the procedures of Section 2.019 of the <br />Eugene Code, 1971. The Rules may be reviewed at the office of the Public Works Department, <br />Administration Division, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours <br />.(9:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />All persons wishing to comment thereon or object thereto must submit their comments or <br />objections to the City's Public Works Department, Administration Division, 858 Pearl Street, <br />Eugene, Oregon 97401, in writing, within fifteen (15) days of the date of the first publication <br />.hereof, as indicated below.
