Administrative Order No. 58-98-16-F <br />Public Works Department <br />City of Eugene, Oregon <br />ADOPTING AMENDED PARK RULES <br />AND REPEALING ADMINISTRATIVE ORDER 58-94-12. <br />The Executive Director of the Public Works Department of the City of Eugene <br />finds that: <br />A. Pursuant to the prior authority of Section 2.812 et se~.of the Eugene Code, <br />1971, (subsequently repealed) which authorized the City Manager or designee to adopt <br />Park Rules, and Administrative Order No. 58-92-21 delegating authority for adoption of <br />Park Rules to the Director of the Public Works Department, on June 24, 1994 I issued <br />Administrative Order No. 58-94-12 adopting amended Park rules. <br />B. Subsequent thereto, and pursuant to the authority of Section 2.019 of the <br />Eugene Code, 1971, I issued Administrative Order No. 58-98-16 proposing the amendment <br />of Park Rules 1.003, 1.007, 1.050, and 1.070, as more particularly set forth .therein. <br />C. Notice of the proposed amendments was published in the Register Guard for <br />five consecutive days, to-wit, on October 3, 4, 5, 6, and 7, 1998, and made available for <br />inspection by interested persons at the City's Public Works Department, Administration <br />Division, 858 Pearl Street, Eugene, Oregon 97401 during normal business hours (8:00 <br />a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br />D. The Notice provided that interested persons could .submit written .comments <br />thereon for a period of 15 days from the first date of publication. No comments were <br />received within the time or in the manner required by the Notice. <br />E. I find that adoption of the proposed amendments is necessary in ordce to <br />insure the preservation of the public welfare and safety of persons using City parks, and <br />further find that the unamended provisions of the Park Rules which were adopted pursuant <br />to authority of sections of the Eugene Code, 1971 which. have been repealed, should be <br />readopted foAowing the currently authorized procedures. <br />Therefore, the Executive Director of the Public Works Department of the City <br />of Eugene orders an.~! directs that: <br />1. Based upon the above findings, and pursuant to the authority of Section <br />2.019 of the Eugene Code, 1971, and Administrative Order No. 58-92-21, Park Rules <br />1.003, .1.007, 1.050, and 1.070 are amended, and the remaining provisions readopted, to <br />Administrative Order Amending Park Rules - 1 ~oiz~iss <br />r_~adminordUules198prkrl2ao.wpd <br />
