ADMINISTRATIVE ORDER N0.58-98-11
of the
~~'
City Manager Pro Tem of the City of Eugene
CONCERNING NOTICE OF INTENDED INCREASE IN
MWMC SEPTAGE USER FEES
The City. Manager Pro Tem of the City of Eugene finds as follows:
A. Section 6.411 (formerly Section 7.020) of the Eugene, Code, 1971 authorizes
the City Manager to determine and set fees and charges to be imposed by the City for.
wastewater service, regional wastewater service, and stormwater service. in accordance
with the procedures set forth therein, and consistent with the requirements of Section 2.020
of the Eugene Code, 1971, on May 23, 1996, Administrative Order No. 58-96-10-F
establishing sewer user rates for the fiscal year commencing July 1, 1996 was adopted.
B. Pursuant to Subsection 6.411(1) of the Eugene Code, 1971, I have
conducted an investigation of the revenue needs of the City in providing these services and
reviewed the recommendation of the Metropolitan Wastewater Management Commission
(MWMC).
C. The MWMC has proposed to increase the septage user charge for MWMC
C wastewater service. The proposed increase is a one-year surcharge to be added to the
current .per thousand gallon (kgal) septic rate for FY99 to recoup the estimated cost of
septage facility improvements. MWMC approved the fee increase on April 22, 1998, as
part of its FY99 budget adoption- process.
D. Based on that investigation and recommendation, lintend to revise the
septage user fees for MWMC wastewater service as set forth in the Notice of Intended
Fees attached as Exhibit A hereto and incorporated herein by reference. I find the
proposed fees are in compliance with the Council's directive tha# the costs of providing
such services be recovered from the beneficiaries of the services, are consistent with
applicable federal and state regulations and the recommendations of MWMC, are based
on the adopted budget of MWMC, and should be implemented effective July 1, 1998.
Those portions of the wastewater and stormwater rate schedules adopted by
Administrative Order No. 58-96=10-F in conflict herewith should be amended as of that
effective date.
On the basis of these findings, I order that:
1. Copies of the Notice be provided to the Mayor and City Councilors, the news
media, any person who has requested notice, to interested governmental agencies
(including the United States Environmental Protection Agency, the Department of
Environmental Quality, MWMC, and the Eugene Water & Electric Board), posted at two
~. locations at City Hall, published on two separate occasions in the Register Guard, a
