`'~, ADMINISTRATIVE ORDER NO. 58-98-09-F <br />of the <br />City Manager Pro Tem <br />AMENDMENT OF AIRPORT RULE 4.8, AND OF EXHIBIT 2 <br />TO THE AIRPORT RULES AS ADOPTED ON MARCH 31, <br />1995 BY ADMII~IISTRATIVE ORDER NO. 58-95-O1. <br />The City Manager Pro Tem of the City of Eugene finds that: <br />A. Sections 2.019 and 2.430 of the Eugene Code, 1971, authorize the City Manager to <br />adopt rules governing the use of Mahlon Sweet Airport ("Airport Rules"). <br />B. In accordance with the procedures set forth therein, on May 8, 1998 I adopted <br />Administrative Order No. 58-98-09 proposing the amendment of Subsection 4.8 of the Airport <br />Rules, as adopted by Administrative Order No. 58-95-01 on March 31, 1995, to include within its <br />prohibitions, conduct that interferes with the use of the Airport facilities by others, interferes with <br />or hinders Airport staff in the performance of their duties, or is inconsistent with the purpose and <br />intent of the Airport. I also proposed that a new Exhibit 2 be attached to the Airport Rules to reflect <br />design changes which have occurred to the designated speech areas within the terminal building <br />-- lobby and sidewalks adjacent thereto as depicted therein. <br />C. The amendment of Subsection 4.8 and Exhibit 2 of the Airport Rules is necessary in <br />order to ensure the peaceful use of Airport facilities by members of the public and facilitate <br />employees in the performance of their duties, and to accurately reflect the current designated speech <br />areas. <br />D. Notice of the proposed amendments thereof was published in the Register Guard, a <br />newspaper of general circulation within the City for at least five days, to-wit, on May 16,17,18,19, <br />20, 1998, and made available for review by interested persons at the office of the Airport Manager, <br />28855 Lockheed Drive, Eugene, Oregon 97402 during normal business hours (9:00 a.m, to 5:00 <br />p.m., Monday through Friday, exclusive of holidays). The notice provided that interested persons <br />could submit written comments thereon for a period of 15 days from the first date of publication. <br />No comments were received within the time nor in the manner required by the Notice. <br />Based on the above findings, which are hereby adopted, and pursuant to the authority <br />contained in Sections 2.019 and 2.430 of the Eugene Code, 1971, I hereby amend the Rules <br />Governing the Use of Mahlon Sweet Airport adopted by Administrative Order No. 58-95-01 as <br />follows: <br />1.
