ADMINISTRATIVE ORDER NO. 58-05-13 <br />of the <br />~' City Manager <br />PROPOSING THE ADOPTION OF A REAL <br />PROPERTY PURCHASE APPLICATION FEE <br />The City Manager of the City of Eugene finds as follows: <br />A. Sections 2.860 through 2.874 of ..the Eugene Code, 1971, authorize the City <br />Manager to dispose of real property pursuant to certain enumerated procedures set forth therein. <br />B. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to <br />determine and set fees and. charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits.. <br />C. The City has, over the years, acquired real property for various projects. Some of <br />those projects, however, did not ultimately use the entirety of the property acquired therefore. <br />As a consequence, the City owns ~a number of small parcels or strips of property that are not <br />~. . <br />needed for a public purpose, and which the City Manager may declare to be surplus property ''~ <br />within the meaning of Section 2.864 of the Eugene Code, 1971. Often, such property is declared <br />to be surplus upon the request of a neighboring property owner so that such a property owner <br />may purchase such property. The proposed application fee is intended to defray the City's costs <br />associated with the declaration of the property as surplus, the cost of advertising the sale of such <br />property, the cost of appraising such property, and the preparation of associated bid packet <br />materials for the sale of such surplus property in the event that a sale is not consummated. If the <br />successful bidder has paid such a fee and completes the purchase, the application fee is credited <br />to the purchase price. If the successful bidder ~ does not complete the purchase, the application <br />fee is forfeited, unless another bidder completes the purchase, in which case the application fee is <br />returned. <br />D. The proposed fee set forth in Exhibit A hereto is consistent with applicable <br />policies and directives of the City Council to recover the cost of services from the direct <br />beneficiaries of those services; and is necessary in the order to defray the City's costs associated <br />with providing those services. <br />E. In accordance with the procedures set forth therein, I intend to adopt an <br />application fee to be paid by an applicant seeking to purchase City-owned properties that have <br />been declared surplus and that are no longer needed by the City for a public purpose. <br />/// <br />/// <br />Administrative Order - 1 <br />00124319.DOC;4 <br />
