ADMINISTRATIVE ORDER N0.58-OS-07 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF <br />FEES FOR ENGINEERING SERVICES FOR PRIVATELY <br />CONSTRUCTED PUBLIC IMPROVEMENTS AND <br />REPEAL OF ADMINISTRATIVE ORDER N0.58-04-14-F <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br />B. In accordance with the procedures set forth therein, and the further authority of <br />Section 7.130 of the Eugene Code, 1971; I intend to amend the Engineering Services Fee <br />Schedule that was adopted by Administrative Order No. 58-04-14-F on August 6, 2004, by <br />increasing the fees as set forth in the Notice of Intended Increase in Engineering Services Fee <br />Schedule attached as Exhibit A. The fee increases are necessary in order to recover the full cost <br />of engineering services for each classification of engineering employee. The proposed fees have <br />been calculated after the annual review of the costs of providing engineering services. <br />C. In determining the proposed fees set forth in Exhibit A, I have considered the <br />applicable policies, enactments and directives of the City Council, the amount charged for these <br />services by the City in the past, the full costs of providing these services supported by the fees, <br />the amounts charged by other comparable providers, and the revenue needs of the City as <br />determined by the adopted City budget. In addition, the fee amendments are necessary in order <br />to comply with the requirements of Section 7.130 of the Eugene Code, 1971, that the fees <br />charged cover the costs, including overhead, of engineering, inspection and review services <br />performed by the city on all private or public improvements not engineered by the city. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice attached as Exhibit A be provided to the Mayor and City <br />Councilors, posted at two locations at City Hall, and be made available for review by interested <br />persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during <br />normal business hours (8:00 a.m. to 5:00 p.m. Monday through Friday, exclusive of holidays); <br />and a copy of the Notice attached as Exhibit B, which identifies those fees that are $250 or <br />greater, be published in the Register Guard, a newspaper of general circulation within the City. <br />2. All persons desiring to comment on the fee amendments shall submit written <br />comments as set forth in the Notice. After expiration of the comment period, I will establish by <br />administrative order the fees as proposed or as modified in response to the comments received, <br />incorporate any unamended fees established by Administrative Order No. 58-04-14-F into the <br />new fee schedule, and repeal Administrative Order No. 58-04-14-F. <br />Administrative Order -Page 1 of 1 <br />
