ADMINISTRATIVE ORDER NO. 58-05-03-F <br />~; ~ _; <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF STORMWATER USER FEES AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 58-04-13-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 6.411 of the Eugene Code, 1971 (EC), authorizes the City Manager <br />to determine and set fees and charges to be imposed by the City for wastewater service, <br />regional wastewater service, and stormwater service. <br />B. In accordance with the procedures of EC Section 6.411, I issued <br />Administrative Order No. 58-05-03 on May 6, 2005, and notified the Mayor and City <br />Councilors, that I intended to increase the fees in the stormwater User Fee Schedule <br />established by Administrative Order No. 58-04-13-F on June 16, 2004, as set forth in <br />Exhibit A attached thereto. <br />C. Notice was also provided to the news media, any person who had requested <br />notice, and to interested governmental agencies (including the United States <br />Environmental Protection Agency, the Department of Environmental Quality, MWMC, and <br />the Eugene Water & Electric Board). In addition, the Notice was posted at two locations at <br />City Hall on May 13, 2005, and published in the Register-Guard, a newspaper of general <br />circulation within the City, on May 13 and 14, 2005. The Notice was made available for <br />inspection by interested persons at the offices of the Public Works Department, 858 Pearl <br />Street, Eugene, Oregon, '97401, during normal business hours (8:00 a.m. to 5:00 p.m., <br />Monday through Friday, exclusive of holidays). <br />D. The Notice provided that written comments would be received for a period of <br />ten days from the first date of publication and posting, and that comments would also be <br />received at the public hearing to be held in the McNutt Room of Eugene City Hall, 777 <br />,Pearl Street, Eugene, Oregon, 97401, on May 26, 2005, between 4:30 PM and 5:30 PM. <br />No comments were received at the public hearing or within the time or in the manner <br />provided in the Notice. <br />E. Pursuant to subsection (1) of Section 6.411 of the Eugene Code, 1971, I <br />have conducted an investigation of the revenue needs of the City in providing these <br />services. <br />F. Based on my investigation, I find that the proposed stormwater User Fee <br />Schedule is in compliance with the Council's directive that the costs of providing such <br />services be recovered from the beneficiaries of the services, and other applicable policies <br />and directives of the City Council; is consistent with applicable federal and state <br />;~~ <br />Administrative Order -Page 1 <br />C:\Documents and Settings\cewehfm\t.ocal Settings\Temporary.Internet.Files\OLK1B\05 stormwater Fees -2ao (00196396)1.DOC <br />
