~':# <br />City right-of-way, City easements and any stormwater facility the City is contractually or <br />legally obligated to operate and maintain, including but not limited, to: <br />1. An open drainage way .serving a drainage basin which has been <br />accepted by the City; <br />. 2. A pipe or sewer and xts related appurtenances which carries <br />stormwater and have been designed and constructed. expressly for.use by the general <br />public and accepted by the City; <br />3. Streets, curbs, gutters, and other surfaces in the public way which are <br />designed to convey stormwater; <br />. 4. Roadside drainage ditches along unimproved City streets, except for <br />. ac_ cess drive culverts smaller than 24 inches in diameter; and. <br />5. 'Flood control and stormwater quality facilities (levees, dikes, <br />~overIlow channels, detention basins, retention basins, dams, pump stations, <br />. groundwater recharging basins, wetlands, etc.) that have been designed and <br />. constructed expressly for use by the general public and accepted by the City. <br />Clean-un. The containment and/or removal of any substance and the mitigation of <br />damage to property or the environment to the satisfaction of ~ federal, state, and local <br />. ~ exlforcemenf personnel.. ~ . <br />Disehazste. Deposition or release of any substance other than storinwater to the city <br />stormwater system, whether deliberate or as an unintended result of any action or failure to <br />.act. Discharges include but are not limited to surface runoff dumping, leaching by <br />stormwater, point. source connections, and spilling of pollutants. <br />.~ ~ ~ Enforcement action. Stop Work Orders, Cease and Desist Orders, Citations, Civil <br />Penalties, Administrative Compliance Orders, or Abatement actions issued, assessed, or <br />_ billed against a responsible party. <br />Enforcement officer, The Director of the City's Public Works Department, or his or <br />her designee.. <br />.. ~I-iindered. Any action which inhibits tiie ability of Citystaffto investigate or mitigate <br />illegal/unproper dischazges to the city stormwater system. This includes, but is not limited <br />to: denying access to a facility to City staff or contract workers attempting to investigate or <br />contain a discharge; providing false information; .withholding information such as product <br />identification, time of spill, source of material, or quantity of material discharged. <br />Illegal/Improper discharge. Factors which constitute an improper/illegal discharge <br />include, but are not limited to: <br />1. Actions or the lack thereof that create °an immediate potential for <br />.pollutants to enter the city stormwater system. , <br />2.
