ADMINISTRATIVE ORDER NO. 58-02-O1 ~ of the City Manager of the City of Eugene PROPOSED AMENDMENT OF STORMWATER SYSTEM ADMINISTRATIVE RULE The City Manager of the City of Eugene finds that: ;x'00 ns7 A. Section 2.019 and Chapter 6 of the Eugene Code, 1971, authorize the City Manager to adopt rules deemed necessary for the administration and enforcement of the provisions of the Eugene Code, 1971. B. Pursuant to that authority, on August 20,1996, Administrative Order No. 58-95-19-F was issued adopting a Stormwater System Administrative Rule which established procedures for an enforcement program designed to discourage violations of the Eugene Code, 1971, relating to improper connections and/or illegal discharges to the City's stormwater system, and/or violations of the City's NPDES stormwater permit and Comprehensive Stormwater Management Plan (CSWMP), which was subsequently amended by Administrative Order No. 58-97-O1-F on June 9, 1997. C. Staff has recommended that Administrative Order Nos. 58-95-19-F and 58-97-01-F be repealed and the Stormwater System Administrative Rule be amended to: (1) Amend the definitions of"Enforcement action," "IllegaVImproperdfscharge," "Industrial waste" and "Removal;" delete the definitions for "Prior enforcement action" and "Repeat;" and add a definition for "Stormwater violations." (2) Amend the formula in Section E, "Determination of Amount of Civil Penalty." (3) Amend Section F, `Enforcement," by adding "Stop Work Order" to the heading of subsection (2) to more accurately reflect the contents of that section. D. I find that the proposed revisions to Stormwater System Administrative Rule as hereinafter set forth are necessary in order to comply with amendments to the Eugene Code, 1971. Therefore, based on the above findings, I hereby propose to amend the Stormwater System Administrative Rule adopted by Administrative Order Nos. 58-95-19-F and 58-97-O1-F as follows: Administrative Order - 1
