ADMINISTRATIVE ORDER NO. 58-02-O1 <br />~ of the <br />City Manager of the City of Eugene <br />PROPOSED AMENDMENT OF STORMWATER SYSTEM <br />ADMINISTRATIVE RULE <br />The City Manager of the City of Eugene finds that: <br />;x'00 ns7 <br />A. Section 2.019 and Chapter 6 of the Eugene Code, 1971, authorize the City Manager <br />to adopt rules deemed necessary for the administration and enforcement of the provisions of the <br />Eugene Code, 1971. <br />B. Pursuant to that authority, on August 20,1996, Administrative Order No. 58-95-19-F <br />was issued adopting a Stormwater System Administrative Rule which established procedures for an <br />enforcement program designed to discourage violations of the Eugene Code, 1971, relating to <br />improper connections and/or illegal discharges to the City's stormwater system, and/or violations <br />of the City's NPDES stormwater permit and Comprehensive Stormwater Management Plan <br />(CSWMP), which was subsequently amended by Administrative Order No. 58-97-O1-F on June 9, <br />1997. <br />C. Staff has recommended that Administrative Order Nos. 58-95-19-F and 58-97-01-F <br />be repealed and the Stormwater System Administrative Rule be amended to: <br />(1) Amend the definitions of"Enforcement action," "IllegaVImproperdfscharge," <br />"Industrial waste" and "Removal;" delete the definitions for "Prior enforcement action" and <br />"Repeat;" and add a definition for "Stormwater violations." <br />(2) Amend the formula in Section E, "Determination of Amount of Civil <br />Penalty." <br />(3) Amend Section F, `Enforcement," by adding "Stop Work Order" to the <br />heading of subsection (2) to more accurately reflect the contents of that section. <br />D. I find that the proposed revisions to Stormwater System Administrative Rule as <br />hereinafter set forth are necessary in order to comply with amendments to the Eugene Code, 1971. <br />Therefore, based on the above findings, I hereby propose to amend the Stormwater System <br />Administrative Rule adopted by Administrative Order Nos. 58-95-19-F and 58-97-O1-F as follows: <br />Administrative Order - 1 <br />
