based upon evidence that the deviation request meets all of the following criteria: <br />3.1 The alternate investigation method will have sufficient geological <br />investigation to locate, design and construct the proposed facilities for long-term safety, <br />structural stability and soundness through a comparable or superior design; <br />3.2 The alternative will not adversely affect health, public safety and welfare,. <br />and/or operation of the structure(s); and <br />3.3 The alternative will not adversely affect maintainability of the structure(s). <br />This Rule shall become effective 30 days from the date that it is adopted as indicated below. <br />This Rule shall apply only to land use applications submitted after the Rule's effective date. <br />Dated 3 ~ day of /~~11~-2GH , 2003. <br />James R.
