• NOTICE OF INTENDED RULEMAKING <br />PROPOSED AMENDMENT OF EROSION PREVENTION <br />AND CONSTRUCTION SITE MANAGEMENT PRACTICES <br />ADMINISTRATIVE RULE . <br />. NOTICE IS. HEREBY GIVEN that pursuant to the authority contained in Sections 2.019 <br />and 6.645 of the. Eugene Code, 1971, the City Manager pro tem_ of the City of Eugene, intends to <br />amend the Erosion Prevention and Construction Site Management Practices Administrative Rule R- <br />6.645 to: <br />1. - :. Amend the definitions of: "Certifed professional," "Construction related <br />materials," "Construction site management plan," `designated buffer," "Dewatering," <br />"Directly drains," "Erosion prevention," "Highly erodible SO1~1S," "Maxunum extent <br />practicable," "Minor recurring activities," `2'ermit holder," `elated natural resource areas," <br />"Responsible person or responsible parry," "Template," ~"Untreated runoff" "Vegetative <br />buffer," and "Visible or measurable erosion," and add new definitions of `Best management <br />practices," `development site," `perimeter control," "Secondary containment," and <br />"Sedimentation;" <br />2. Amend the Applicability section inRule R-6.645-C to include more detail, and <br />provide for termination of the exemption; <br />3. Amend subsectionsl.3, 1.4, 1.8 and 2.3 ofRule R 6.645-D; <br />4. Amend subsection 2 of Rule R-6.645-E to clarify the criteria for challenging <br />the Director's preliminary determination regarding classification of a sensitive site; <br />5. AmendRule 6.645-F to clarifythe requirements for permits, the classifications <br />ofpernrits, permit processing procedures, Construction Site Management Plan requirements, <br />and duration of permits; <br />6. Amend subsection 1.4 and add a new subsection 1,7 to R-6.645-G concerning <br />construction site practices; and <br />7. Amend the last paragraph ofR-6.645-I by adding the word "habitat" after " <br />significant threat to life, public safety, property ...." <br />8. Correct three erroneous references to the end date of the wet weather season <br />from June 15 to Apri130. <br />Adoption of the proposed amendment of the Erosion Prevention and Construction Site <br />Management Practices Administrative Rule R-6.645 is necessary in order address issues that have <br />arisen during implementation of its provisions, and to assure conformity with applicable provisions <br />Notice <br />C:\TEMP~3ErosionPrev Notwpd <br />
