ADMINISTRATIVE ORDER N0.58-03-01 ` <br />of the <br />_, City Manager pro hem of the City of Eugene <br />PROPOSED AMENDMENT OF EROSION PREVENTION <br />AND CONSTRUCTION SITE MANAGEMENT PRACTICES <br />ADMINISTRATIVE RULE 6.645; AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 5&00-26-F <br />The City Manager pro tem of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 6.645 ofthe Eugene Code, <br />1971, on December 15, 2000, Administrative Order No. 58-00-26=F was issued, adopting revised <br />provisions for the City's program for managing erosion and other negative waxer quality impacts <br />associated with construction activities. <br />B. Staffhas recommended the following revisions to the rules to address issues that have <br />arisen during implementation of its provisions, and to assure conformity with applicable provisions <br />of the Eugene Code, 1971: <br />1. Amend the definitions of"Constnuction related materials," "Construction site <br />. management plan," `designated buffer," `~ewatering," `Birectly drains," "Erosion <br />• prevention;" `highly eroch~ble sods," `2Vlaximum extent practicable," `2Vlinor recurring <br />activities," "Permit holder," "Related naxtual resource areas," "Responstble person or <br />responsible party," "Template," "Untreated runoff," "Vegetative buffer," and "V~sible or <br />measurable erosion," and add new definitions of`Best management practices," "Development <br />site," `~'erimeter•control," "Secondary containment," and "Sedimentation;" <br />2. Amend the AppficabditysectioninRule R 6.645-C to include more detail, and <br />provide; for termination of the exemption; <br />3. Amend subsectionsl.3, 1.4, 1.8 and 2.3 ofRule R-6.645 D; <br />4. Amend subsection 2 of Rule R 6.645-E to clarify the criteria for challenging <br />the Director's preliminary determination regarding classification of a sensitive site;. <br />5. Amend Rule 6.645-F to clarifythe requirements for permits, the classifications <br />ofpermits, permit processing procedures, Construction Site Management Plan requirements,. <br />and duration of permits; <br />• 6.
