2.H TEMPORARY SURFACING PERMITS. <br />SCOPE: The City of Eugene has adopted code provisions and administrative rules that specify the <br />standards and procedures for fully improving a street within a public right-of--way to City standards <br />and acceptance by the City for maintenance. However, to facilitate better access to their property, <br />an abutting property owner(s) may wish to make minor improvements in the public right-of--way <br />short of those full improvements to City standards. While street improvements to full City standards <br />are recognized as the preferred long term solution, often there are issues outside the control of the <br />abutting property owner that makes aless-than-full improvement a viable option. <br />The City has established these standard processes allowing an abutting property owner to prove that <br />full improvement is not a viable option and that a better alternative is the granting of a temporary <br />surfacing permit to the abutting property owner(s) to make minor and temporary access improve- <br />ments within the public right-of--way until such time as a full improvement becomes possible. <br />A temporary surface permit shall be obtained prior to the placement of any private surface upon, over <br />or under the public way. The permittee shall be required to pay all permit fees and user fees. <br />Issuance of a temporary surfacing permit does not relieve the permittee from obtaining any other <br />permits that may be required. Examples of other permits that may be required are erosion, tree <br />removal, and wastewater or stormwater connection. As with all right-of--way permits, the City <br />reserves the right to revoke or cancel the pexrnittee's permission to use the public way at a later date. <br />Temporary surfacing permits shall be subject to conditions approved by the City Engineer or <br />designee including, but not limited to, standards for temporarytraffic control, constructionpractices, <br />and right-of--way restoration included herein. See EC 7.290 <br />The City will not perform maintenance activities for temporary surfacing installed pursuant <br />to this permit process. <br />2.H.1 Application. <br />Application to use the public way under either a "Type One" or "Type Two" temporary surface <br />permit maybe made to Surface Operations staff at either the Maintenance Division Office, 1820 <br />Roosevelt Boulevard, Eugene, OR 97402 or the Permit and Information Center, 99 West l0t'' <br />Avenue, Eugene, OR 97401. <br />Applications shall be made on a standard form provided by the City.
