ADMINISTRATIVE ORDER NO. 21-04-02 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF THE PUBLIC <br />RECORDS REQUESTS FEE SCHEDULE; REPEAL OFADMINISTRATIVE <br />ORDER NO. 44-93-08; AND REPEAL OF THE PROVISIONS OF <br />ADMINISTRATIVE ORDER NOS. 21-02-02-F, 44-92-05, 52-00-02-F, 53-02-07- <br />F, 53-03-04-F, 56-01-02-F, 57-OZ-08-F, 57-03-01-F, AND 58-03-10-F THAT ARE <br />IN CONFLICT THEREWITH. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use ofmunicipal property, and <br />licenses and permits. In accordance with those provisions, Administrative Order No. 44-93-08 was <br />issued on October 15, 1993 adopting an amended Public Records Fee Schedule. <br />B. A Public Records Committee (the "Committee") was created in 2001 to review the <br />City's policies and practices related to the release of public records and the fees charged for doing so. <br />As a result of that review it became apparent that the responses to requests and the fees being <br />charged were not consistent, and varied between the different departments. In order to avoid these <br />inconsistencies, the Committee has recommended that a Public Records Requests Fee Schedule be <br />adopted that establishes uniform fees to be charged by all City departments and a process for <br />considering requests for fee waivers. <br />C. I have reviewed and concur with the recommendation of the Committee, and I intend <br />to adopt the Public Records Requests Fee Schedule as set forth in the Notice attached hereto as <br />Exhibit A, and repeal any portions of Administrative Orders that are in conflict with that schedule. <br />D. In determining the proposed fees set forth in Exhibit A hereto, I have considered the <br />applicable policies, enactments and directives of the City Council, provisions of state law related to <br />public records, the costs of providing the services supported by the fees, the amounts charged by <br />other comparable providers, and the revenue needs of the City as determined by the adopted City <br />budget. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice attached hereto as Exhibit A be provided to the Mayor and City <br />Councilors, posted at two locations at City Hall, and be made available for inspection by interested <br />persons at the office of the City Manager, 777 Pearl Street, Eugene, Oregon 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays).
