Comment 19: Landscaping and tree establishment is ,seasonal -dependent on <br />weather. <br />Fin in I agree: New trees have the best chance of survival if planted when they <br />are dormant in the late fall and winter months. R-7.280-D.7.1, which specifies the limits <br />of the planting seasons for various types of trees, was included. for just this reason. <br />Comment 20: Do not require the establishment of street trees, landscape and <br />irrigation systems until home is completed. <br />Fin in :Neither the Eugene Code, 1971 provisions nor .the implementing rules <br />require the planting of the street trees prior to the completion of the home. However, the <br />Code provisions do place the responsibility on the developer to ensure the trees are planted <br />and established.. <br />. If the developer chooses to plant and establish the trees, the administrative rules <br />set requirements for the developer to show how the trees, if planted early, will not. conflict <br />with later construction. If the ,developer elects. to wait until home construction is <br />completed, the rules require the developer to show how (s)he will track the completion of <br />specific home construction projects and provide for the trees to be planted at that time. <br />If the developer chooses to delegate tree planting to the .City, the City takes full <br />responsibility for tracking -° home .construction and -the subsequent planting and <br />establishment of the street trees. <br />Based on 'the above fmdings, I hereby adopt the proposed Street Tree Program <br />Administrative Rule R-7.280 as modified herein: <br />STREET TREE PROGRAM <br />ADMINISTRATIVE RULE R-7.280 <br />R-7.280-A Street Tree Program - Poli <br />In order to create attractive and healthy neighborhood environments no approval shall be <br />granted for a development that involves the creation of a street unless the applicant has submitted <br />..and received approval of a Street Tree Plan pursuant to R-7.280-B.1 or executed an agreement <br />with the City pursuant to R-7.280-B.2 that ensures street trees will be planted and established in <br />accordance with the standards and procedures provided for in these rules and the adopted policies <br />of the Urban Forest Management Plan. Street trees shall be planted as each lot or area is <br />developed and shall be required on that portion of street right-of--way that abut lots within the <br />development as well as on new streets within the development site. <br />Administrative Order - 7 <br />
