7.4.4 Changes to An Approved Credit Application <br />~ Whether established by the City using the "equal lot" .method or by the property <br />owner(s)/applicant(s), any modifications to the distribution of credits may be changed at <br />any time, will require a new completed application, must be approved by the City <br />Engineer, and will be effective only upon approval by the City Engineer of the revised <br />credit application. The revised distribution will apply only to the remaining credit balances <br />and undeveloped lots or building sites, and must comply with the rules outlined in the SDC <br />Policies and Procedures Manual. <br />7.5 Decision on Application for Credit <br />The City Engineer shall approve, conditionally approve, or deny an application in writing, setting <br />forth the reason for the decision. Such a decision shall be mailed or,personally delivered to the <br />applicant. <br />7.6 Credit and Impact Reduction Duration <br />Credits granted under this methodology document may be applied to SDC fees for a <br />development up to a maximum of 10 years from the date of the original written notification. <br />Impact reductions granted under this methodology document may be applied to SDC fees for <br />a development until such time as the program or improvements no longer continue to provide <br />the anticipated reduction in demand, and the City has determined that assurances or <br />agreements from the developer, owner, or owners successors, are no longer adequate to <br />ensure that the program or facility will continue to function as planned for the agreed upon time <br />period. <br />8.0 Appeals <br />An appal by an applicant or a permittee of any decision of the City Manager under these <br />Methol9~iogies shall be governed by Eugene Code., 1971 section 7.735 and must be filed and the <br />appeal fee paid within 15 working days of the date of the decision. Such appeals shall be in writing <br />and filed at the City Manager's office. A separate appeal must be filed for each decision being <br />appealed. The appeal fee, as established under Eugene Code, 1971 section 2.020, can be found <br />in the current adopted SDC Fee schedule in <br />Appendix F. <br />9.0 Interested Persons Notification <br />The City shall maintain a list of persons who have made a written request for notification prior to <br />adoption or amendment of a methodology for any SDC. For the purpose of this section, the close <br />of the public comment period required under Eugene Code, 1971 section 2.020 constitutes the <br />hearing date. The City shall mail written notification to persons on the list at least 45 days prior to the <br />first h~~ing to adopt or amend a system development charge. The methodology supporting the <br />adopt ors or amendment will be available 30 days prior to the first hearing to adopt or amend a <br />systems development charge. The failure of a person on the list to receive a notice that was mailed <br />will not invalidate the action of-the City. The City may periodically delete names from the Interested <br />Persons List or require a new written request for notification be made if the person wished to remain <br />City of Eugene SDC Methodology Page 15 <br />
