ADMINISTRATIVE ORDER NO. 58-00-01 of the City Manager of the City of Eugene PROPOSING AMENDMENTS TO AND RENAMING OF TREE PRESERVATION ADMINISTRATIVE RULE R-6.305 The City Manager of the City of Eugene finds that: A. Sections 6.305 through 6.330 of the Eugene Code, 1971, contain the permit requirements, application procedure, and appeal process relating to the City's tree preservation program. Section 2.019 authorizes the City Manager to adopt rules for implementation of any provisions of that Code. B. In accordance with the procedures set forth therein, Administrative Order No. 58-96- 22-F was adopted on February 28, 1997, amending Tree Preservation Administrative Rule R-6.305 and repealing prior administrative orders. C. Since adoption of Administrative Order No. 58-96-22-F, changes have occurred with respect to some of the City's administrative practices associated with this program, and I therefore intend to rename the rule and amend the definitions, permit requirements, application procedure, criteria for permit approval, permit issuance, and the exceptions provisions of Administrative Rule R-6.305 to more accurately reflect those practices, and add new provisions relating to enforcement and computation of the administrative civil penalty, as set forth herein and in the Notice of Intended Rulemaking attached as Exhibit A hereto. Therefore, based upon the above findings, and pursuant to the authority of Sections 2.019 of the Eugene Code, 1971, the City Manager proposes to: Rename, and amend Tree Preservation Administrative Rule R-6.305 as follows: TREE REMOVAL PERMIT PROGRAM ADMINISTRATIVE RULE R-6.305 R-6.305-A DEFINITIONS.
