both specific projects targeted for waterway enhancement (i.e., Greenhill Tributary) and a general <br />category, Stormwater System Rehabilitation, that will include waterway enhancement efforts on an <br />on-going basis. <br />2. ~Tnit Costs.. As part of the City's Stormwater Basin Planning Project, costs <br />associated with recommended categories of capital improvement projects were estimated. The <br />estimated unit cost for the "natural resource revegetation" project category is representative of the <br />type of improvements needed to replace impacts and includes the following elements: <br />(a) Removal of existing invasive vegetation. <br />(b) Regrading as needed. <br />(c) Revegetate with appropriate, native vegetation. <br />(d) Maintenance and remedial planting. <br />This Unit Cost of $25 per square yard ($21/sq yd for construction, site preparation, re-vegetation, <br />and maintenance; plus 20% for contingency for engineering/design and administrative/legal services) <br />is hereby established as the Open Waterways Mitigation Fee Rate. <br />The following examples are provided to illustrate how the unit cost would result in mitigation <br />fees for exemptions associated with typical creek crossings: <br />Driveway - 12 feet wide minimum for single family lot and channel width is: <br />10 feet: mitigation fee = $333.25 [10'x12' = 120 sq ft/9 sq ft = 13.33 sq yds x $25]. <br />15 feet: mitigation feet = $500 [15'x12' = 180 sq ft/9 sq ft = 20 sq yds x $25]. <br />Local Residential Street - 21 feet minimum width and channel width is: <br />10 feet: mitigation fee = $582.50 [10'x21' = 210 sq ft/9 sq ft = 23.3 sq yds x $25] <br />15 feet: mitigation fee = $875 [15'x21' = 315 sq ft/9 sq ft = 35 sq yds x $25] . <br />R 6.650-K Open Waterways -Enforcement. <br />1. Stop Work Order. Upon finding an activity is occurring that violates EC 6.650 - <br />6.670, this rule, or a condition of a permit or agreement, the City Manager may issue a stop work <br />order to the property owner or permittee. The stop work order need not require the cessation of all <br />operations on the premises, only those activities causing or contributing to the violation. In addition <br />to any other penalties that may be imposed, failure to comply with an order issued under this <br />subsection constitutes a violation of this rule and the provisions of Chapter 6 of the Eugene Code, <br />1971 under which it is promulgated, punishable as set forth in EC Sections 6.992 and 6.995. <br />Administrative Order - 9 r:~no~a~-ui~~ooW.wpa~o6iosioo~ <br />
