Avenue, in an area above 500 feet in elevation, or in an area with slopes that have grades <br />exceeding 10 percent. <br />(c) All required state and federal permits have been approved and issued. <br />(d) The proposal is consistent with existing local plans and policies. <br />(e) The proposal is consistent with applicable city stormwater development <br />requirements and design specifications including drainage, flood control, water quality <br />treatment, related natural resources protection and maintenance access needs. <br />3. Decision. The City Manager shall review the application and issue a decision thereon <br />in the manner provided in R-6.650-I. <br />R 6.650-I Review Procedure. <br />1. Completeness Review. The City Manager shall review applications submitted <br />pursuant to this Rule to determine whether all required documentation and signatures have been <br />provided and required fees paid. Unless .determined complete, no further review of the application <br />will occur. <br />2. Notice. Prior to acting on an application submitted under R-6.650-E, R-6.650-G, or <br />R-6.650-I~ the City Manager shall cause a notice thereof to be provided to the owners and occupants <br />of property adjacent to the property for which the application is submitted, published in a newspaper <br />of general circulation within the City, and forward a copy of the notice to the neighborhood group <br />for the area iri which the property is located. The notice shall describe the application, the exemption <br />approval being applied for, and the subject property. The notice also shall provide that persons may <br />submit written comments on the application as directed therein,. for a period of not less than 15 <br />calendar days from the publication date of the notice. <br />3. Decision. Following the expiration of any required public comment period, the City <br />Manager shall issue a decision approving, approving with conditions, or denying an application, and <br />mail a copy thereof to the applicant. Notice of the decision and the manner in which it may be. <br />appealed shall also be mailed to any persons who submitted written comments on the application and <br />provided a return address. The decision may require that the applicant enter into an Open Waterway <br />Modification Agreement with the City that describes the approved use or activity and any conditions <br />that are made a part of the Agreement, including any other permits that must be obtained prior to <br />commencing work on the site. In order to reduce the effects of modifications to the waterway, the <br />City Manager may also attach conditions to the permit or Agreement that include, but are not limited <br />to, conditions requiring the planting of specific native vegetation, site specific measures designed to <br />reduce negative impacts downstream, and measures to protect habitat. Failure to comply with any <br />of the conditions of a permit or Agreement may result in the issuance of a stop work order, or the <br />Administrative Order - ~ r:~i~~oow..~a~o6iosioo~ <br />
