R-6.650-D Open Waterways -Pre-Application Evaluation. <br />Any person seeking approval of an exemption from the open waterway piping and filling <br />prohibitions may elect to file an application for a preliminary, non-binding evaluation of whether <br />required avoidance and minimization of impacts will be met by the proposal. Apre-application <br />evaluation is not required, and an applicant may file an application in the manner provided in R-6.650- <br />E through R 6.650-H without going through the pre-application process. If a person chooses to seek <br />a pre-application evaluation, the person shall submit an application to the City Manager on a form <br />prescribed by the City Manager; shall include an application fee in an amount established by the City <br />Manager pursuant to Section 2.020 of the Eugene Code, 1971; and shall include the signature of the <br />property owner, or the owner's authorized agent. The application shall: <br />(a) Identify the exemption approval being requested; <br />(b) Describe the proposed improvements; and <br />(c) Include documentation that supports that the impact cannot otherwise be <br />avoided or minimized. <br />A favorable evaluation under this process does not constitute approval of or authorization of an <br />exemption, and shall not bind the City if a formal application is submitted under R-6.650-E through <br />R-6.650-H of this Rule. The evaluation may, however, be considered as part of the approval process <br />for issuance of a permit. <br />R 6.650-E Open Waterways -Prior Approved Filling-Piping Plan Review (EC 6 660.1. <br />1. Application. Prior to initiating any piping or filling for which final approval had been <br />given prior to May 24, 2000, the owner of the property or permittee shall submit an application to <br />the City Manager on a form prescribed by the City Manager for approval of a plan for minimising and <br />mitigating negative impacts to the waterway. The application shall be accompanied by: <br />(a) An application fee and plan review fee in the amounts established by the City <br />Manager pursuant to Section 2.020 of the Eugene Code, 1971; <br />(b) Documentation of the prior final approval; and <br />(c) The proposed plan. <br />The application shall be signed by the property owner, or the owner's authorized agent. <br />2. Criteria for Approval.
