ADMINISTRATIVE ORDER NO.58-00-15 <br />of the <br />City Manager of the City of Eugene <br />ADOPTION OF OPEN WATERWAY <br />TEMPORARY ADMINISTRATIVE RULER 6.650. <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.019 ofthe Eugene Code, 1971, authorizes the City Manager to adopt rules <br />for implementation of any provisions of that Code. In addition to that authority, Sections 6.650 <br />through 6.670 establish policies, prohibitions, and procedures related to piping and filling of open <br />waterways within the City. Those sections, which were added to the Eugene Code, 1971 by <br />Ordinance No. 20194 adopted on April 24, 2000, effective May 24, 2000, authorize the adoption of <br />administrative rules to implement and assist with enforcement of the provisions. <br />B. Adoption of this Temporary Rule is authorized by Section 2.019(5) of the Eugene <br />Code, 1971, and is necessary in order to ensure that piping and filling of open waterways occurs only <br />as authorized by these newly adopted provisions of the Eugene Code, 1971 in accordance with the <br />procedures established in this Rule. <br />Now, therefore, based on the above findings, which are hereby adopted, and pursuant to the <br />authority of Sections 2.019(5) and 6.665(3) of the Eugene Code, 1971, <br />The City Manager of the City of Eugene Orders that: <br />1. The following Open Waterways Temporary Administrative Rule R-6.650 is hereby <br />adopted, to provide: <br />OPEN WATERWAYS TEMPORARY <br />ADMINISTRATIVE RULER 6.650 <br />R 6.650-A Open Waterways -Purpose. <br />It is the purpose of this Rule to implement, and assist with the enforcement of, Sections 6.650 <br />through 6.670 of the Eugene Code, 1971 by defining terms applicable to those provisions; <br />establishing procedures for review of applications for approval of exemptions, criteria for that <br />approval, criteria for mitigation proposals; and establishing enforcement and appeal procedures. <br />Administrative Order - 1 ~ r:~n~a~„ ~~~ooW~..~a~o6iosioo> <br />
