Master Certification Agreement No. 24651 <br /> City of Eugene Contract #2009-00241 <br /> AMENDMENT NO. 1 <br /> LOCAL AGENCY CERTIFICATION PROGRAM <br /> American Recovery and Reinvestment Act of 2009 <br /> Supplemental Project Agreement No. 25302 <br /> Delta Ponds Path: Goodpasture Island Road -Robin Hood Avenue <br /> City of Eugene <br /> <br /> The STATE OF OREGON, acting by and through its Department of Transportation, <br /> hereinafter referred to as "State;" and CITY OF EUGENE, acting by and through its <br /> designated officials, hereinafter referred to as "City," entered into Local Agency <br /> Certification Program, Supplemental Project Agreement No. 25302 on March 19, 2009. <br /> Said Agreement covers the construction of agrade-separated bicycle/pedestrian facility <br /> crossing over Delta Highway connecting Goodpasture Island Road on the west and <br /> Robin Hood Avenue on the east, hereinafter referred to as "Project". <br /> It has now been determined by State and City that the Supplemental Project Agreement <br /> referenced above, shall be amended to increase the federal funds and add $2,225,000 in <br /> <br /> American Recovery and Reinvestment Act of 2009 funds to cover a funding shortfall <br /> caused by increased construction costs and reduction in available HPP funds and City <br /> revenue for the Project. Except as expressly amended below, all other terms and <br /> conditions of the Agreement are still in full force and effect. <br /> Insert new RECITALS, Paragraphs 4 and 5 to read as follows: <br /> <br /> 4. The American Recovery and Reinvestment Act of 2009, hereinafter referred to as the <br /> "ARRA", provides funding for job preservation and creation, infrastructure investment, <br /> energy efficiency and science, assistance to the unemployed, and state and local <br /> fiscal stabilization, for fiscal years 2009 and 2010. <br /> 5. The ARRA provides each state asub-allocation of ARRA funds for Transportation <br /> Enhancement activities. <br /> TERMS OF AGREEMENT, Paragraph 2, Page 1 which reads: <br /> 2. The total estimated cost of the Project is $4,844,000, which is subject to change. <br /> Shall be deleted in its entirety and replaced with the following: <br /> 2. The total estimated cost of the Project is $6,216,000. The Project estimate is subject to <br /> change. <br /> Key No. 15222 <br /> <br />
