The $2,650,980 amount differs from $2,880,000. Talked with Steve Leep 4/7/09 around 4:30 pm. It looks like limitations and rescissions have been deducted for FY05-08 with full amount for FY09. Limitations and rescissions amounts should be available within the month. PWAtds

City of Eugene /State of Oregon -Dept. of Transportation <br /> Agreement No. 25302 <br /> are estimated at $2,650,980. The federal pro-rata funding for the portion funded by <br /> HPP funds is 89.73 percent and provided federal funds will be subject to annual <br /> obligation limitations and possible rescissions. The HPP funds will be used for all <br /> phases of the Project. <br /> 4. The High Priority Projects Number and Project Description are as shown in the table <br /> below: <br /> Federal Bill Project Description <br /> Number <br /> 313 Delta Ponds Bike/Pedestrian Path <br /> 5. A portion of the Project shall be .conducted as part of the Transportation <br /> Enhancement (Enhancement) Program under Title 23, United States Code, which <br /> incorporated SAFETEA-LU. The Enhancement Funds are estimated at $1,000,000. <br /> The Enhancement funds shall be used for construction of the Project. <br /> 6. City shall pay all Project costs. State will reimburse City with federal HPP and <br /> Enhancement funds. City will provide the match for all federal funds. All costs <br /> beyond the federal reimbursement and any non-participating costs, including all <br /> costs in excess of the available federal funds, will be the responsibility of the City. <br /> 7. City shall make all payments for work performed on the Project, including all <br /> construction costs, and invoice State for 100 percent of its costs. State shall <br /> reimburse City invoices at the pro-rated federal share. All costs beyond the federal <br /> reimbursement, any deposited local funds, and any non-participating costs will be <br /> the responsibility of the City. State shall perform work in the estimated amount of <br /> $10,000. State shall send monthly invoices to City's Project Manager. City <br /> understands that State's costs are estimates only and agrees to reimburse State for <br /> the actual amount expended. <br /> <br /> 8. City must obtain approval from State's Transportation Enhancement Program <br /> Manager for any additional funds beyond the amount in Paragraph 5 above. For <br /> additional Enhancement funds up to a total of $1,100,000, ten (10) percent over the <br /> $1,000,000 estimated Enhancement funding, City's match share will be 10.27 <br /> percent of Enhancement-eligible costs. For any approved Enhancement funds <br /> above $1,100,000, City's matching share will be fifty (50) percent of the <br /> Enhancement-eligible costs. <br /> <br /> 9. City shall select consultants, design, advertise, bid, award the construction contract, <br /> and construction administration. City understands that this Project is a test project <br /> and agrees to comply with all of .the terms and conditions found in Certification <br /> Program Agreement No. 24651. <br /> Page 2 of 7 <br /> <br />
