Conditions
<br /> 1, .The applicant represents all parties and interests ,and shall furnish material, do all work, pay all costs, and shall,
<br /> within the time specified, restore any damaged portion of the public way to a condition similar or equal to that
<br /> existing before the commencement of the described work or uses, including seeding or sodding necessary unless
<br /> expressly required by the City in writing to restore the public way to a higher standard.
<br /> 2, The proposed work, use, etc. requested shall be located and constructed to the satisfaction of the City Engineer
<br /> or his duly authorized representative. No revisions ar additions shall be made to the propased scope of work
<br /> affecting the public way without the written permission of the City,
<br /> 3. The applicant and his agents sha11 be responsible for obtaining any and all permits necessary to work outside of
<br /> the public ways.
<br /> 4. The applicant shall, at all times, conduct the work or activity in such a manner as to minimize hazards to
<br /> vehicular and pedestrian traffic. In performing work or use in the public way, the applicant shall provide traffic
<br /> control acceptable to the City Engineer. A11 required traffic controls, i.e., signs, barricades, flaggers, etc., shall
<br /> be furnished by the applicant, unless specific rental arrangements have been made with the City Public Works
<br /> Maintenance Division for use of City equipment, The actual work shall be done during daylight hours, unless
<br /> night work is expressly authorized by the City.
<br /> S. The applicant and his successors or assignees agree to hold harmless the City of Eugene and its duly appointed
<br /> agents and employees against any action for personal injury or property damage sustained by. reason of exercise
<br /> of a permit, if granted.
<br /> 6. A permit, when granted, is effective only insofar as the City has jurisdiction and does not release the applicant
<br /> from the duty to check with utility companies for utility locations.
<br /> 7, After the permit is issued, if the permittee fails to perform as requires in the Eugene City Code, the land use
<br /> application approval, ar regulations of conditions stated in this permit, the City may take any or all of the
<br /> following actions: ~a}issue citations for violations of the law, (b} issue a stop work order until permittee has
<br /> corrected the violations or nonperformances, tc} required permittee's surety perform the work for which the
<br /> permit was issued, (d} use City employees or contractors to complete the work the work and charge the costs
<br /> thereof to permittee's surety or to permittee's security deposit held by the City, ~d} revoke the permit or ~f~ take
<br /> any other judicial or administrative action necessary to insure the performance of the work required by the
<br /> permit.
<br /> S. The applicant afflnms that the scope of the proposal shown on submitted plans is true and correct, and binds and
<br /> obligates himlherself to perform the operation in accordance with the permit and related plans, and to abide by
<br /> all conditions of the permit.

<br /> 9. Any errors or omissions in the approved plans or information used as a basis for such approvals may constitute
<br /> grounds for withdrawal of any approvals andlor stoppage of any or all of the permitted work, as determined by
<br /> the City, It shall be the responsibility of the Developer and his agent to show cause why such work should
<br /> continue, and make such changes in the plans that may be required by the City before the plans are reapproved.
<br /> 14. The applicant understands that engineering design review, construction inspection, and lab test costs maybe
<br /> billed monthly until construction is complete, until as built plans have been received and accepted and until the
<br /> City has accepted the work at the beginning of the warranty period. Further, the applicant agrees to pay the City
<br /> the amount billed within 10 days of the billing date. Also, within 10 days of being billed, applicant shall pay
<br /> the City the cost of any extra inspection or enforcement required as a result of the issuance of the permit,
<br /> including attorney's fees and costs in administrative or judicial proceedings or appeals therefrom.
