Ok, I will contact the attorney's office and review/discuss with them - they had worked on it <br />in the past and prepared the Access Easement and Defense & Indemnity Agreement, but will ask <br />them to also review the easement we prepared. <br /> <br />Neil, Sue, and I met once on the matter and Sue has talked with the bond attorney, but <br />perhaps she can review any concerns on the revised agreement with him. <br /> <br />As to costs, perhaps you and Neil can review your available funding relative to what project <br />costs are expected to be - perhaps even obtain some bids for the proposed work, if necessary. <br /> <br />I will be leaving the end of this week and gone for 2 weeks. Lloyd has had most of the <br />discussions about the easement with the owners and he will continue to be available. One of the <br />agreements more specifically pertain to the conservation easement encumbering the entire YPA <br />property lying south of SMJ and the proposed joint parking lot. The second pertains more to <br />the stairs leading up to the house and was an agreement prepared by one of the attorneys to <br />address the replacement of the present stairway leading from the parking lot to the front <br />porch of the SMJ house. Lloyd and I have discussed how to lay out the agreements. We <br />combined the Conservation with Parking easement along with proposed maintenance and related <br />use conditions - all into one document. We discussed combining the other stairway easement <br />that had been previously prepared, but decided it might be best to keep them as separate <br />documents, because of the history of the stairway and access agreement. <br /> <br />Please review and identify any concerns or further clarifications you feel should be <br />considered. A certain amount will depend upon the boards of the 2 properties working <br />together, such as having to do with the shared usage at peek times, as well ongoing shared <br />maintenance.
