City of Eugene <br /> Federal Courthouse Improvements <br /> Page 2 of 3 <br /> Under RECITALS, add Provision No. 5 as follows: <br /> 5. The City and Oregon Department of Transportation (ODOT) have developed a prospectus and <br /> entered into an intergovemmental agreement for $7,600,000 in transportation improvements for the <br /> Courthouse District. The intergovernmental agreement requires a local match of 20% or $1,600,000. <br /> COUNTY AGREES TO, No. 2., page 1, which now reads: <br /> 2. COUNTY shall transfer road funds to CRY upon receipt of invoices de#ailing eligible project costs in <br /> accordance with all pertinent laws and regulations required of and by COUNTY and upon satisfaction of <br /> all agreement terms. <br /> Shall be amended to read: <br /> 2. COUNTY shall transfer road funds to CITY upon receipt of invoices detailing eligible project costs in <br /> accordance with all pertinent laws and regulations required of and by COUNTY and upon satisfaction of <br /> all agreement terms. Advance deposits made by CITY to ODOT for anticipated Road Fund eligible <br /> expenditures allowable under the Oregon Constitution, Article IX, Section 3a, may be reimbursed by <br /> COUNTY subject to all pertinent taws and regulations required of and by COUNTY and upon satisfaction <br /> of all applicable agreement terms. CITY shall maintain any and all advance deposits in the CITIES Local <br /> Government Investment Pool (LGIP) account. All LGIP interest earnings on the advance deposit balance <br /> will be credited to the COUNTY, thereby reducing the final road fund transfer for eligible expenditures. In <br /> the event applicable project costs do not exceed the advance deposit provided by COUNTY, CITY will <br /> return that amount plus accrued interest to COUNTY within three months of project completion. <br /> CITY AGREES TO, No. 7., page 2, which now reads: <br /> 7. CITY agrees that the federal courthouse transportation improvements covered by this agreement will <br /> be within CITY jurisdiction and will remain CITY improvements within the CITY's Urban Growth Boundary. <br /> CITY will be responsible for all maintenance associated with the improvements. This provision shall <br /> survive termination of this agreement. <br /> Shall be amended to read: <br /> 7. CITY agrees that the federal courthouse transportation improvements covered by this agreement will <br /> be within CITY and State of Oregon jurisdiction. CITY will have jurisdiction over the local street <br /> improvements and the State of Oregon will have jurisdiction over the state highway improvements. The <br /> improvements are within the CITY'S Urban Growth Boundary. CITY will be responsible for all <br /> maintenance associated with the improvements under CITY jurisdiction. It is understood COUNTY will <br /> <br /> not have operational or maintenance responsibility for the project improvements in its entirety.
