Contracts and Agreements <br /> No. 17935 <br /> FUND EXCHANGE AGREEMENT <br /> CITY OF EUGENE <br /> Amendment No. 4 <br /> The State of Oregon, acting by and through its Department of Transportation, <br /> hereinafter referred to as "State", and CITY OF EUGENE, hereinafter referred to as <br /> "Agency," entered into an Agreement on September 21, 2000, Amendment No. 1 on <br /> September 25, 2002, Amendment No. 2 on October 17, 2003, and Amendment No. 3 <br /> on September 21, 2004. Said Agreement covers 1999 Fund Exchange for the City of <br /> Eugene, Neighborhood Transportation Improvements. <br /> It has now been determined by State and Agency that the Agreement referenced above, <br /> although remaining in full force and effect, shall be amended to extend the termination <br /> date and update language. <br /> Paragraph 1 of Recitals, Page 1, which reads: <br /> 1. By the authority granted in ORS 366.770 and 366.775, State may enter into <br /> cooperative agreements with counties and cities for the performance of work on <br /> certain types of improvement projects with the allocation of costs on terms and <br /> conditions mutually agreeable to the contracting parties. <br /> Shall be deleted in its entirety and amended to read: <br /> 1. By the authority granted in ORS 190.110, 366.572 and 366.576, State may enter <br /> into cooperative agreements with counties, cities and units of local governments for <br /> the performance of work on certain types of improvement projects with the allocation <br /> of costs on terms and conditions mutually agreeable to the contracting parties. <br /> Paragraph 4 of Terms of Agreement, Page 1, which reads: <br /> 4. The term of this agreement shall begin on the date all required signatures are <br /> obtained and shall terminate on October 31, 2006, unless otherwise extended or <br /> renewed by formal agreement of the parties. <br /> Shall be deleted In its entirety and amended to read: <br /> 4. The term of this Agreement shall begin on the date all required signatures are <br /> obtained and shall terminate on October 31, 2008, unless otherwise extended or <br /> renewed by formal agreement of the Parties. <br /> <br />
