i <br /> ' If the developer chooses to delegate tree planting to the City,. the City takes full <br /> responsibility for tracking home construction and the subsequent planting and <br /> establishment of the street trees. <br /> Based on the above fmdin s I hereb ado t the ro osed Street Tree Pro ram <br /> g, Y P P p g <br /> Administrative Rule R-7.280 as modified herein: <br /> I <br /> STREET TREE PROGRAM <br /> ADMINISTRATIVE RULER 7.280 <br /> i <br /> R-7.280-A Street Tree Program - PolicX. <br /> In order to create attractive and healthy neighborhood environments no approval shall be <br /> <br /> j ~ granted for a development that involves the creation of a street unless the applicant has submitted <br /> and received approval of a Street Tree Plan pursuant to R 7.280-B.1 or executed an agreement <br /> with the City pursuant to R-7.280-B.2 that ensures street trees will be planted and established in <br /> accordance with the standards and procedures provided for in these rules and the adopted policies <br /> of the Urban Forest Management Plan. Street trees shall be planted as each lot or area is <br /> - developed and shall be required on that portion of -street right-of-way. that abut lots within the <br /> ,FE development as well as on new streets within the development site.. <br /> As used in these rules, an "approved Street Tree Plan" is: <br /> a) A plan prepazed and submitted by an applicant, that meets the requirements <br /> of these rules, and is .accompanied by all required fees andJor security deposits, or; <br /> b) An agreement entered into by the applicant and the.. City. whereby the City <br /> assumes responsibility for the purchase, installation, and establishment of street trees in <br /> . accordance with the standards set.forth in these rules. <br /> R-7.280-B Street Tree Plan -Application. <br /> 1: An application for approval of a Street Tree Plan (Plan) shall be submitted to the <br /> City, together with the application processing and review fees established by the .City Manager <br /> pursuant to Section 2.020 of the Eugene Code, 1971. The City's Urban Forester shall review the <br /> Plan and approve or deny the application based o~n the Plan's compliance with the requirements <br /> and standards established in these rules. <br /> 2. As an alternative to the requirements of subsection 1 of this section, upon payment <br /> of the applicable fees, an applicant may enter into an agreement with the City whereby the City <br /> assumes responsibility for the purchase, installation, and establishment of street trees in <br /> accordance with the standards set forth in these rules. <br /> 3.
