To provide for such, a 14' wide easement for underground utilities shall be <br /> reserved to extend from your remainder property, crossing the panhandle strip and <br /> ~ extending westerly to Bailey Hill Road The specific location of the easement shall be <br /> determined and approved by both parties prior to closing of escrow. <br /> It has also been discussed that the adjacent property owner to the north, Dan Leahy, has <br /> an interest in purchasing a small portion of the subject property. The City is to have the <br /> option to continue negotiations with Mr. Leahy as to a sale of a portion of the subject site. <br /> Based upon the previous offer Mr. Leahy made to you, the area would be less than 3 <br /> acres in size in the northerly most portion of the subject parcel. If said negotiations are <br /> successful, the City would be responsible for the costs associated with completing the <br /> necessary property line adjustment to consummate such a partial sale. As owner/seller, <br /> you would agree to participate in executing the necessary documents to process the <br /> I <br /> property line adjustment. The condition would be you will still receive the same <br /> proceeds from the closing of escrow, but a portion of the City's funds may come from the <br /> partial sale to Mr. Leahy. <br /> If the terms and conditions of this proposal are acceptable, .please sign the Acceptance of <br /> j Offer and return the entire letter to me at your convenience - a copy of the offer letter has <br /> been enclosed for your convenience. <br /> The City of Eugene very much appreciates your consideration of this offer.
