As part of the conveyance it is agreed the deed will reserve <br /> a utility easement along the southerly most 14 feet of the b0' panhandle strip of tax lot <br /> 5106 from Bailey I-IiII Road and extending southeasterly 170' to provide an easement for <br /> present and future underground waterlines and utilities to serve the Evans remainder <br /> parcels. This easement should extend about 40' east of the ~srest~•ly property Line of the <br /> Evan's tax Iot 4901. It is further aclrnowledged the location of the existing waterline is <br /> not specifically known at this time, but. the waterline may remain and Evans will have <br /> rights to access it for necessary maintenance until such time a new waterline is installed_ <br /> At such time the Evans further develop their remainder property or install any new <br /> waterlines er.utilities theyT .will be located in the ne=ri~ 14' easement being created by <br /> reservation in the deed, as described above_ The intent will be to extend a new waterline <br /> and related utilities from existing available utility sources to-the Evans remainder <br /> property while rrtinimizing impacts to the property being acquired by the City_ <br /> The Evans and the City are continuing to process uhe property tine adjustment application <br /> which will adjust the common line between tax lot S10b and tax lots 4800 and 5004.
