One of the affected parcels is a parcel that now belongs to John Metimucei
(sp?). When we began the acquisition the property belonged to someone else who granted us the permit of entry
to do the work. During the project negotiations the property was sold. We continued negotiations but the owner
wanted significantly more than the appraisal and market data could support. We increased the amount of the
offer a reasonable amount in an attempt of a settlement. At that point our options were to pay substantially more
than market value, fife a condemnation action, or just wait. Since the project was completed, we couldn't find
justification to pay more, and frling condemnation was very expensive. It was determined we should not pay
more than the upper settlement amount we offered, and to defer any legal filing unless the owner initiated.
A cou le mont s a o an attorne re resentin the owner contacted us a ain and we went throe h the a raised
p h 9 Y p 9 9 9 pp
, values, market adjustments, etc. He has now agreed to the settlement and it will be about $30,400 as we
j previously agreed to. We need to order a check, but were not sure what would be the appropriate funding
source? I don't recall if there may have been anything set aside at the time of the project. Otherwise could you
recommend the most appropriate fund? !f anyone wants anymore of the details, don't hesitate to check with
either Lioyd or me. Thanks.
