VI-22 Eugene Charter VI-25 <br /> Section 22. Oath or Affirmation. All elective officers, the municipal judges, and the city <br /> manager, before entering upon the duties of their offices, shall subscribe <br /> and file with the head of the department in charge of city records an oath or affirmation <br /> of office. The oath shall read: "I, , do solemnly swear that I will <br /> support the constitution of the United. States and of the State of Oregon, and that I will, <br /> to the best of my ability, faithfully perform the duties of during my continuance therein, <br /> so help me God." If the person affirms, instead of the last clause of the oath, there shall <br /> be stated: "And this I do affirm under the pains and penalties of perjury." <br /> Section 23. Offices -Vacancies. An office becomes vacant upon its incumbent's <br /> death, removal from the city, resignation, or ceasing to be a qualified <br /> elector of the city. An elective office becomes vacant whenever its incumbent is absent <br /> form the city for a period of thirty days,.except that the council may grant the incumbent <br /> a leave of absence of not more than ninety days. An office of councilor may be <br /> declared vacant whenever its incumbent fails to attend two consecutive regular <br /> meetings of the council, unless absent upon leave of the council first obtained, or <br /> whenever the incumbent removes his or her residence from the ward from which he or <br /> she is elected. <br /> Section 24. Vacancies -Filling. The Eugene Water & Electric Board shall fill a <br /> vacancy on the board by appointment within ninety days after the vacancy ° <br /> occurs. The council shall fill a vacancy in any other elective city office by appointment <br /> within ninety days after the vacancy occurs. A person so appointed shall hold offce <br /> <br /> . until the beginning of the first year after the next regular biennial November election and <br /> until the successor to the office is duly elected and qualifies therefor. The term. of office <br /> of any person elected to fill such a vacancy shall expire when the term of the person <br /> whose death, removal, or resignation causes the vacancy would have expired had that <br /> person continued in the office. <br /> Section 25. Collective Bargaining. <br /> (1) City employees shall have the right to self-organization; to form, join, <br /> and assist labor organizations;~and to bargain collectively through representatives of <br /> their own choosing with respect to wages, ~ hours, and other terms and conditions of <br /> employment. <br /> (2) The city manager shall bargain collectively on behalf of the city council <br /> with the representatives of city employees in an appropriate bargaining unit upon <br /> request of their certified bargaining agent. <br /> (3) The council shall prescribe by ordinance collective bargaining <br /> procedures to protect the city, the employees, and the public in general. In so doing, <br /> the council shall provide for: <br /> (a) impartial ordinance administration and enforcement; <br /> -6- 01/01/97 <br /> _ _ <br /> <br />
